Jon Fitch fired over video game, then rehired

A bitterly angry Dana White said Wednesday the Ultimate Fighting Championship has cut highly regarded welterweight contender Jon Fitch and is not going to do business with any fighters who are part of the American Kickboxing Academy team in San Jose, Calif.

The outspoken UFC president said shortly after landing in Hawaii on Wednesday that he no longer wants to work with AKA fighters or those represented by DeWayne Zinkin and Bob Cook.

White said he excepted AKA welterweight Mike Swick from that group because he said Swick called him and told him he wants to fight for the UFC. But Fitch and heavyweight Christian Wellisch were cut on Wednesday, and heavyweight prospect Cain Velasquez and welterweight Josh Koscheck could be next.

We’re looking for guys who want to work with us and not against us, and frankly I’m just so [expletive] sick of this [expletive] it’s not even funny,” White said from Honolulu, where he flew Wednesday from Toronto to hold a news conference to announce the B.J. Penn-Georges St. Pierre fight for UFC 94 on Jan. 31 in Las Vegas.

“Affliction is still out there trying to build its company. Let [Fitch] go work with them. Let him see what he thinks of those [expletives]. [Expletive] him. These guys aren’t partners with us. [Expletive] them. All of them, every last [expletive] one of them.”

Fitch said Wednesday the dispute was over his reluctance to sign a lifetime contract to allow his name and likeness to be used in a video game the UFC is planning with THQ. He said the dispute has nothing to do with money and that he never caused a problem during his time in the UFC.

He said he simply didn’t understand the need to sign a lifetime contract, particularly since it would not pay his family in the event of his death.

Wow, so I didn't realise that things were so bad between the UFC and American Kickboxing Academy, that Dana White would go and start firing fighters. Especially a guy who had his last fight as a championship fight.

I just read this and found it surprising.

I also heard that GSP won't be in the video game because of his new marketing contract.

Losing Fitch and Koscheck would damage the welterweight division in the UFC but not cripple it. They can easily pick up Jake Shields and Nick Diaz to replace them.

losing swick, Josh and Cain Valesquez would totally suck too...

I don't get Dana though man, he's so tempramental and always throws anyone he doesn't get along with under the bus.. and then he'll act like they're best buddies if they do end up doing business together again.. dude has some serious personality problems I swear.. he also has the luxory of not having any real competition for talent so he can be shitty too them too.

Any management team that would risk an entire camp of fighters being fired isn't working in their best interests. You can play hardball all you like but you don't put UFC brass between a rock and a hard place or they will just cut you.

yeah, but is Dana over reacting a little here? Does this mean if a fighter leaves the UFC and joins another org and they do a video game, they aren't allowed to be in it?

there has to be some type of compromise and Jon Fitch sounds totally reasonable in his comments thus far.
I wonder how this is going to ultimately turn out.

Now is not the best time for a fighter to be unemployed and on the outs with Zuffa. Will this kind of exploitative pressure be standard operating procedure for the UFC as their competition continues to die out? Bad, bad times. We’ll keep you posted…

Fitch’s release a calculated attempt to send fighters and their managers a message

Wednesday’s news that former UFC welterweight title challenger Jon Fitch had been released from the promotion continues to send shockwaves through the industry. Many managers and agents are distressed by the news and are bracing for the worst. Within the past 12 hours, FiveOuncesOfPain.com has spoken with several of the top fighter representatives in the business to gain perspective on the situation.

After speaking with a healthy sampling it’s readily apparent that Fitch’s release cannot be pinpointed to a single issue, as the UFC’s decision to drop him was the result of a number of factors manifesting at the same time.

First and foremost of the issues was the refusal of Fitch’s trainers and manager with the San Jose-based American Kickboxing Academy and agents at Zinkin Entertainment to recommend that their clients sign a marketing agreement that would surrender lifetime video game likeness rights to the UFC.

While Five Ounces of Pain has yet to speak with representatives at AKA or Zinkin, industry insiders have informed us that they were not happy with being asked to sign away lifetime rights. Fitch publicly stated on Wednesday that the lifetime rights provision and the manner in which the UFC went about demanding it was a major issue.

“…Then we finally asked, after reading through the contract, why can’t we negotiate for different terms? Because it asked me for a lifetime contract for the video games, so they would have exclusive rights to use our likeness for these video games and we couldn’t go and do any other video games ever again in our lifetime,” Fitch is quoted as saying during an interview with MMA Weekly.

During a Wednesday night radio interview on “The Carmichael Dave Show” on KHTK in Sacramento, UFC president Dana White was asked about why a shorter term agreement wasn’t an option and a heated White responded by saying that he didn’t feel signing over lifetime rights should be an issue.

“Let me ask you a question.” White began to respond when host Carmichael Dave asked why the UFC was demanding lifetime rights as opposed to asking for a five or ten-year agreement. “I’ve got an even better question for you: Jon Fitch takes off and becomes a huge superstar in another league somewhere else. Do you think we are going to keep him in a video game? Do you really think when the new video game comes out that we’re going to have the guy who is a huge superstar somewhere else be in our video game!? It’s common sense! People are so stupid sometimes it actually hurts my brain. Okay? He comes out and becomes this huge headliner for this future promotion somewhere else; I’m going to keep him in my video game and keep promoting him?”

Coupling Fitch’s public statements with what has been told to what Five Ounces of Pain privately, the concern isn’t whether the UFC will use a fighter’s likeness if he is no longer with the organization. The issue is that a fighter’s new promotion will be unable to use the fighter’s likeness because the UFC will have lifetime ownership. As such, a fighter’s value to another promotion is diminished if he does not retain control over his own likeness. While the UFC would be unlikely to use the likeness of a fighter no longer in the UFC for video game purposes, the fighter’s new employer wouldn’t be able to use it as well.

It appears that the UFC may have gotten itself into a bit of a predicament as sources indicate that THQ, who is producing promotion’s upcoming video game release “UFC Undisputed 2009,” operated under the auspices that they had exclusive rights to the likenesses of all fighters on the UFC roster. Five Ounces of Pain has been informed that THQ was none too pleased upon learning that rival Electronic Arts has commenced work on an MMA game of its own and that plans are in motion to involve a great deal of recognizable fighters. The sources have indicated that in addition to names such as Randy Couture, Tito Ortiz, and Frank Shamrock that known UFC fighters could potentially be featured as well.

The fact that THQ had been promised exclusive access to the likeness of the entire UFC roster when the UFC wasn’t in a position to make such an assurance is believed to be a reason why the promotion has acted in haste in regards to demanding its fighters sign over their likenesses for “Undisputed.”

Sources have stated that UFC officials chose to make an example of Fitch to send a message to other agents and managers. The feeling was that Fitch was expendable and his status as an elite fighter would be an effective way to help try and convince other fighters to fall in line.

White himself confirmed during the KHTK interview that Fitch received $169,000 for his co-headlining fight vs. UFC welterweight champion George St. Pierre at UFC 87. Despite ascending to a pay level of a headliner, there were no plans to have Fitch headline again. The former Purdue wrestling standout fell into a group of UFC fighters such as Fabricio Werdum and Marcus Aurelio that are on a mid-tier pay scale that have been cut because it was determined their salaries were not commensurate with their positioning on fight cards. Sources have added that the UFC’s roster currently resides at 183 fighters but Vice President of Talent Relations Joe Silva is instructed to get the roster down to 140.

Despite his reputation for being one of the best in his weight class, Fitch was apparently not viewed by UFC officials as someone who possessed star charisma, which in turn limited his marketing potential. Fitch was not in line to receive a title shot in the near future and that there was a concern he would stand in the way of potential challengers that the UFC has designs on building up for the future.

Additional sources have informed Five Ounces of Pain that White’s decision to speak out publicly against the American Kickboxing Academy and Zinkin Entertainment was the manifestation of difficulties of negotiating with the groups in the past. The two parties had been two of the most vocal against some of the marketing proposals that the UFC had hoped its fighters would sign.

With Fitch and Christian Wellisch already dropped, there is now a great deal of speculation regarding the UFC futures of AKA fighters Josh Koscheck, Cain Velasquez, and Mike Swick.

Sources have indicated that Swick has already contacted the UFC in an attempt to express his desire to continue fighting for the promotion and willingness to negotiate a likeness deal on his own. White confirmed Swick’s desire to cooperate during the KHTK interview.

In a clear attempt to try and entice fighters to leave AKA and Zinkin, White sent a message to non-UFC fighters that train at the gym by intimating that their prospects of fighting for the promotion are damaged as long as they are affiliated with the AKA or Zinkin. If fighters such as Velasquez and Koscheck do not break ranks and sign the agreement, they could be cut.

For now, Koscheck will remain with the UFC as he is slated to headline against Yoshiyuki Yoshida during the promotion’s “UFC Fight Night 16: UFC Fight for the Troops” event on Dec. 10 in Fayetteville, North Carolina. His future with the UFC beyond that date is uncertain. While several industry insiders that we’ve spoken to believe that Koscheck will remain with the UFC, that’s hardly a given considering his close ties to AKA and Zinkin.

“My manager, Bob Cook, I’m on the phone with him every day. When I’m in training camp I actually live with him. And I have Dwayne Zinkin, who is the president. When I’m in Fresno he’s almost like my father,” Koscheck told Five Ounces of Pain during an interview published on March 12 of this year.

“He’s a good guy. I’m at his house every night. My girlfriend and his girlfriend are sisters. So we have a very close relationship and Zinkin Entertainment is one of the best management companies out there.”

they're going down to 140 fighters??? sounds like the UFC is trying to cut costs in case the recession hits them hard too. I've also read that ZUFFA inc took out a rather large loan several years ago to expand the UFC and it's coming due within the next year or so, so they may be getting ready for that too.

JON FITCH EXCLUSIVE: "I'M STILL KIND OF IN SHOCK"

Shockwaves were sent through the world of mixed martial arts on Wednesday night with the news that top welterweight fighter Jon Fitch had been dropped from the Ultimate Fighting Championship following a contract dispute.

Just hours after learning of his release, Jon Fitch spoke exclusively to MMAWeekly.com about the situation that led to the events that have now made him a free agent.

"This is like over the course of two days, three days," Fitch explained about the release. "It had to do with Dana (White) calling my managers and immediately saying, 'we need to get him to sign this contract' and 'it's a big favor to me.' Then we asked him, 'Why do you need this contract signed?'

"Then we finally asked, after reading through the contract, why can't we negotiate for different terms? Because it asked me for a lifetime contract for the video games, so they would have exclusive rights to use our likeness for these video games and we couldn't go and do any other video games ever again in our lifetime."

Before anything was decided, Fitch says his managers tried to re-negotiate a different deal from the lifetime contract, but an ultimatum was soon made.

"So basically we said we weren't cool with that deal and why can't we do it for five or 10 years? Why does it have to be a lifetime deal? Their next response was, 'either you guys are in or you're out' and 'sign this or you're going to get dropped from the UFC,'" said Fitch. "So we hear that and we didn't even think they were serious. Why would you want to release fighters at our level over something like that? Doesn't make any sense.

"Within two phone calls, it got to 'sign this or you guys are out.'"

The American Kickboxing Academy welterweight standout explained that the situation for the urgency of the contract from the UFC might have stemmed from another company, EA Sports, putting out an MMA video game of its own. Apparently the UFC had promised all of its fighters exclusively to THQ, the makers of the upcoming UFC Undisputed 2009 game scheduled for release in spring of 2009.

"We were already promised to THQ by the UFC, even though none of us were under contract (for that), in order to save face, they had to force us to sign this thing," he explained.

He also states that the new video game contract was partially due to the fact that competitors in the UFC were originally given a "merchandising" contract that was shot down after many fighters did not want to sign that either.

"It started with the merchandising agreement," Fitch stated. "The original merchandising agreement they sent out, it encompassed all avenues of all this stuff and everything that falls under merchandise, and they wanted to force us to sign that a while ago. (They wanted) all the guys in the UFC to sign these contracts blindly that gave them all of our rights, image, everything that they could find anyway to market or sell us."

The Indiana born fighter went on to talk about his confusion following a tenure with the UFC that included nine fights, eight of which were wins, and a hard fought five-round decision loss to Georges St. Pierre that has garnered talk for "Fight of the Year."

"This is seriously how they're trying to treat fighters? Especially me? " Fitch questioned. "I've never complained about them. I've always done my best for the UFC in a positive way. I've fought my ass off. I'm arguably the second best welterweight in the world. Yet they are still willing to release me, especially after my last fight?

"Just because I lost, it sure as hell wasn't because of lack of effort or poor performance."

The day started with Fitch confirming his next fight in January against Akihiro Gono, but just as quickly, he received a rescinded contract from the UFC for the bout agreement, and shortly thereafter, a voided promotional contract effectively releasing him from his fight contract.

"We got the bout agreement returned today and then later tonight they released me from my promotional contract. So at the moment, I'm no longer with the UFC. I'm unattached right now," Fitch commented.

While the deal to sign a lifetime contract didn't necessarily appeal to Fitch, he says it was the manner of which the deal was brought to the table that ultimately angered him the most.

"Honestly the contract wasn't even that big of a deal," he said. "We're not getting paid for it anyways, and it's not a deal where I'm actually going to get another deal with a video game agency. I don't have that kind of pull, most guys don't. It has nothing to do with that. It's that they brought this contract to us and basically kicked in our front door, came in guns blazing, and said 'sign this contract or you're dead.'"

Regardless of the contract situation, Fitch feels the mistreatment is simply unacceptable and he is willing to move on if that's what has to happen.

"I am the UFC's bastard son," Fitch said adamantly. "I mean, from the get go. I don't even know how better to explain it. They didn't have any regard or care for me whatsoever. There's nothing more I want than to be the UFC champ, but something like this and they're going to throw me away?

"I also have confidence in the fact that I'm one of the best fighters in the world. I'm going to find a home, and I'm going to find a way to make money no matter what the deal is. I will not be treated and talked to like a dog."

A fighter with the talent of Jon Fitch will likely be snatched up by another promotion very soon, but still he is just shocked at the way everything happened.

"It's not like I've been bad mouthing them or doing anything negative toward the UFC at all. All I've done is go out there and fight my ass off. I'm at a loss. I don't even know what to think right now. I'm still kind of in shock."

“This is not an attack on Jon Fitch. It’s not an attack on any one fighter. We have chosen not to do business with this camp called AKA. These guys have never, ever, ever treated us like partners. They’re always fighting over stupid, stupid (stuff) and negotiating over stuff that makes no sense. They’re negotiating like they’ve got Mel Gibson and this thing is the biggest movie ever being made. You know what I’m saying? The reality is, we’re not even sanctioned in Massachusetts or New York … (and) we’re going into all these different countries trying to do these different things. And I’ve got these guys that basically don’t want to be partners with me. You’ve got morons �" morons �" that are running these fighters’ lives. But to tell you the truth, one of the fighters from AKA called me and said, “Listen, I don’t care what these managers say or what they’re doing. I make my own decisions and my decision is, I’m with you. I’m your partner, I’m in.’ And this was before we even told AKA we wouldn’t be doing business with them any more. So this really isn’t an attack on Jon Fitch or any personal fighter. We’re just choosing not to do business with AKA any more. We’re not going to do business with them. And listen, there’s other guys out there that they can go do business with; they’re just not going to do business with me. Now there’s rumors out there, I know, about, ‘It’s over a video game deal. It’s over the ancillary rights agreement. It’s over this, that.’It’s over a lot of different things. It’s not one specific fighter or one specific thing. It’s about a lot of different things with a lot of these fighters. And you know what? This is more than just AKA. There’s other camps out there that we’re having trouble doing business with. And at the end of the day, this is a business. We run a business just like any other business. You come in, you do your job with your company and you get paid. And the guys that don’t want to do business with you �" then go work somewhere else. It’s as easy as that. You don’t have to do business with us. There’s other people out there you can do it with.”

This is the UFC flexing it's muscles without any other strong orgs around for the fighters to go to. They're dictating terms and if the fighters bow under now, it sets a dangerous precident for all other camps and managers who are currently pretty much powerless because of the lack of options.

But unlike other pro sports when one team cuts you you can't go to another team and get paid. You either fight for the UFC or accept less and fight elsewhere.

This move by UFC pisses me off. As a promoter I suppose Dana is alright, but as someone thats suppose to be running a respected, sporting organization hes horrible. I hate these bullying tactics hes always trying to employ.

Former UFC welterweight Jon Fitch was a guest during Thursday’s edition of Fight Network Radio with Mauro Ranallo and responded to a series of public comments that UFC president Dana White has made regarding his release from the organization.

When asked if he felt the UFC was making a power play against his trainers and managers, Fitch was clear in stating that he felt that was precisely the case.

“It’s 100 percent a power play,” Fitch told Ranallo. “Our management team is one of the toughest and best management teams out there. Honestly a lot other management teams look to us as far as what we’re doing and what we’re saying about other contracts and he knows that. So his answer is to shut down that management team.”

Fitch was adamant his belief the the UFC is taking punitive action against his trainers and managers at the American Kickboxing Academy and his agents at Zinkin Entertainment.

“They are coming out and they are trying to break us,” Fitch continued. “They are trying to break Zinkin Entertainment and get us to jump off a ship. They are trying to send a message to the rest of the (fighters) out there.”

While White has stated publicly that he has nothing against personal against Fitch and that the decision to release him was a business move against AKA and Zinkin, Fitch feels otherwise.

“It’s 100 percent personal,” the former welterweight title challenger said. “They are making an example of me because I haven’t done anything wrong. I’m the perfect example of what a UFC fighter should be; someone who goes out there ad lays it on the line (and) fights their ass off. I never say anything negative about the company. I always put a positive light on everything and anything that has happened to me. Even the s— (about) getting left at the airport from the first season of The Ultimate Fighter; not being shown on the main cards; (and) not getting some of the best fights…”

Fitch has also heard some of White’s public responses and the former Purdue wrestler feels there are some credibility issues in what the UFC president is saying. He specifically took issue with White’s position that fellow AKA member Mike Swick is siding against his teammates.

“Dana is saying ‘Oh Swick said he doesn’t care what his manager said’ or whatever,” began Fitch. “No Swick has a special deal with the video game agreements and a some of this other stuff. A lot of these guys that he says he doesn’t have a problem with are guys that got special contracts along the way. They don’t have the same contracts as everybody else. They get special things, which is fine, and I’m not even asking for those things… The only thing that we stated and stated over time is that we don’t want to sign lifetime contracts.”

Some of the most telling comments of the interview came when Fitch indicated that he and his management team were the apparent victim of strong-arm tactics during negotiations.

“(Dana White) said in the process of the threats that they were making about us signing this video game agreement,” he said. “He made those threats. ‘What are you going to do? Where are you going to go? Good luck trying to fight somewhere else.’ This was in the process of the negotiating. This is what he was saying to us.”

But Fitch’s most intriguing revelation came when he said that his management actually advised him to sign away his likeness and that it was his decision and his decision alone not to ink the deal.

“He tries to blame this and put this off on management but my management was telling me to sign this video game deal. But out of principle, I didn’t. It’s on me, not on my management.”

Basically the UFC is trying to break a strong management team so they can dictate to all the fighters how things go. They want total control. If they can topple AKA's managers, what's to stop them from doing it to others who don't feel 'grateful' for the scraps the UFC throws there way.

Fitch is back!!! because he didn't negotiate with Dana!!! smart move IMO.

Just shy of a day after the reported dismissal of Jon Fitch by the UFC, It appears the two have come to an agreement and the top 5 welterweight has returned to the company.

The news was first reported by MMARated this afternoon.

It is being reported that Fitch spoke with UFC co-owner Lorenzo Fertitta this afternoon and the parties managed to resolve their differences, and the fighter will sign the much talked about video game licensing agreement.

Fitch still stands by his assertion that he didn’t appreciate the way Dana White treated the fighter when attempting to negotiate a deal for video game licensing.

At this point everything appears to be resolved and the scheduled fight with Akihiro Gono at UFC 94 appears to be back on.
