You can't put a person over the age of 21 in jail for having an open container of alcohol in public, but you can fine them . . . that's not criminalization but the gov't is allowed to take money out of your pocket if you don't do what they say. Sounds like regulating behavior to me. But again, we are bantering over semantics.
If they can fine you for an open container, it is a criminal offense. If they tell you that you can have an open container on the south side of the street but not the north side, then it's regulation.
It's not a criminal offense, it's legal designation is a violation. Also it doesn't fit your definition of criminalization, gov't can't put you in jail for an open container. Plus the gov't does tell you that you can have that open container inside a establishment or in designated outdoor seating area, but as soon as you walk onto the street it is a violation of open container. If you then take a sip, it is drinking in public and a crime. But I'm not sure where this is going anymore.
It fits THE definition. It is either a misdemeanor or an infraction. These laws are enacted at the municipality level. I don't think it should be regulated. Let people grow and sell it freely. It's fair that DUI is a criminal offense, selling to minors, etc.

I see people making comparison of pot to alcohol in all these discussions. I can't really see the connection. Pot's more like codeine that you smoke. If smoking cigarettes are bad and raises everyones ire, how the hell does pot smoking come in as Ok? Anyone ever been in a place where the pot smoke is heavy? It's fucking terrible, had to leave a Willie Nelson shindig once due to pot smoke out of control. Then there was this bar in Hyder Alaska, a lawless place you can only get to by boat from the US. A road in from Canada but hardly used and sure not by any US law. One bar in the town and the whole dam town is in there daily getting wasted. Pot smoke too thick to possibly test if the beer smells Ok. Utopia I suppose for a pot head but what a fucking waste of humanity. I will vote against this everyday. Hell I want to see the fuckers that sell this shit to kids hung, not make the it legal. Don't give me this crap that it is better than alcohol, hell I have fired people that were devoted to pot and not their job. Hey MarAzul You and I see eye to eye on most things. To correct a few misconceptions, the guys that grow are not targeting children. That is more of an intercity gang thing, and more often it is crack, not weed. For the most part , kids do not have the money till they are in high school and working or more often in collage before they are experimenting with drugs. I have also seen the bars in Alaska in the 70s and 80s it was the wild fucking west..Ketchican had 28 churches and 34 bars with only 13 miles of road..the nice thing if the smoke got too thick you could walk down the street to the next watering hole. Hahahha The Islands were worse.. Dunno if you have spent any time in that pot culture, but the growers I know are above board or extremely private, they dont chase children around to sell them a joint..that is the fucking media sponsored bull shit .. take a look at some of the recent studies being conducted and revisit the legit studies done in Israel, the shit that has been perpetrated by the Fed is absolutely fictitious. Just like declaring it a schedule one drug because they had not enough information on it...pfffft I would much rather have someone I love smoke weed rather than drink.. that includes my parents..my children and my grand children..
