I'm posting this because UCF was in a similar situation with a guy like Lyles, except they knowingly paid a street agent, and were given the LOIC violation.

I'm feeling extremely positive that there won't be a bowl ban for Oregon, if UCF, who intentionally violated NCAA rules on recruiting and benefits, won their appeal.

UCF has won its NCAA appeal and will be eligible for a bowl game in 2013, according to two UCF sources with direct knowledge of the decision.

It is rare for a school to win an NCAA appeal, but UCF officials insisted they had a strong case protesting the postseason ban the Knights were supposed to serve during the 2012 season.

Parkinson is the guy who last week was on local radio destroying the hopes and dreams of Canzano by saying there is little chance of major penalties for the Ducks.

Jerry Parkinson, a law professor at the University of Wyoming who served as appeals coordinator for the NCAA Committee on Infractions from 2000 to 2010, said schools have won only about 10 percent of appeals since a bylaw was changed in January 2008.

The bylaw currently says the committee can overturn a penalty only if there is an abuse of discretion by the NCAA committee on infractions, Parkinson said. Prior to that change, decisions could be overturned if the committee felt a penalty was excessive or inappropriate and relief was granted in 50 percent of the appeals.

“This is a big deal,” Parkinson said. “If it comes down on Monday and it is a reversal, it is a big deal. It is unusual in light of the change of standards.”
