Poland okays forcible castration for pedophiles

WARSAW (Reuters) - Poland on Friday approved a law making chemical castration mandatory for pedophiles in some cases, sparking criticism from human rights groups.

Under the law, sponsored by Poland's center-right government, pedophiles convicted of raping children under the age of 15 years or a close relative would have to undergo chemical therapy on their release from prison.

"The purpose of this action is to improve the mental health of the convict, to lower his libido and thereby to reduce the risk of another crime being committed by the same person," the government said in a statement.

Prime Minister Donald Tusk said late last year he wanted obligatory castration for pedophiles, whom he branded 'degenerates'. Tusk said he did not believe "one can use the term 'human' for such individuals, such creatures."

"Therefore I don't think protection of human rights should refer to these kind of events," Tusk also said.

His remarks drew criticism from human rights groups but he never retracted them.

"Introducing any mandatory treatment raises doubts as such a requirement is never reasonable and life can always produce cases that lawmakers could never have even dreamt of," said Piotr Kladoczny from the Helsinki Foundation of Human Rights.

"If somebody is of sound mind, we punish him. If he is sick, we try to cure him -- that's how it works in Polish law. This bill introduces both approaches. As far as I know, this makes our law the strictest in Europe on this issue," Kladoczny said.

What gets me is these human right groups protecting the pedophiles, criminals, etc (in many other cases as well).

Pedophiles should be hanged or burned or whatever else you can think of.

I don't have a problem with it as an option for judges to use. I do have a problem with it being mandatory. If an immature and naive 18 year old boy has sex with a 14 year old girl who has already slept around a lot and it's technically statutory rape, a judge should have the latitude to make the right decision.

I really don't understand why people think that judges, guys with graduate-level intelligence and generally strong commitments to justice, aren't better qualified to make these calls on a case-by-case basis than a legislature working on broad, un-focused ideas that make great media sound bites.

This would be horrible if it passed and an innocent person, in the event they were falsely convicted, was forced to receive a mandatory chemical castration.

I do agree though that the punishment of child molesters is far too lenient - anyone convicted of child molestation should be given an automatic life sentence with no chance at parole.

I never understood a life sentence with no parole. Just kill the person instead of spending tax payer money on them, only if they have a chance of overturning the descition should they be granted a life sentence with no parole.

Because the same applies to the death sentence as my fear for mandatory chemical castration - what if you execute an innocent person? You can't take back sending an innocent person to jail for life, but you can get them out of jail with years left if they're found to be innocent through any of the numerous Project Innocent or similar programs out there. You can't resurrect an innocent person who has been executed.
