the fix for this issue being only an executive order that this administration can dissolve was attempted by the republican controlled congress before the democratic house majority of 2019. the senate was able to pass potential legislation but was unable to get it through the house when the president indicated that he was opposed to it.
the current house has passed a permanent replacement last summer, the dream and promise act. mitch mcconnells has as is typical refused to allow for the bill to be taken up by the senate.
the court has probably done the administration a favor, for if the white house had been handed a win here, they would have been forced to revoke a policy that roughly 3/4 of american voters approve of and allowed the need for supreme court appointments of a conservative view to be reinvigorated in their campaigns' coalition IMHO. he gets to play the divisive victim card again too.
