...after being sued by ARod last year, why should the players union go out of their way to help ARod ?
 
Unfortunately the MLBPA is obligated to help him, especially in regards to preventing damages related to the drug policy. As the agreement works to my understanding, you do your time/pay your fine, and then life begins a new as if nothing ever happened.

But from the Yanks perspective, performance bonuses linked to marketability and related income. If one takes PEDs is that akin to contract fraud? I think they have a case because most people will see this as a reasonable interpretation. Good precedent too with Lance Armstrong paying back the prize money won for his 7 tour wins.
 
... "help" is a relative term...just because they are required to represent him doesn't mean they'll go "balls to the wall" in doing so.

...hell, they players wanted him kicked out of they union last year...don't look for a concerted effort in the MLBPA working hard for ARod.


...and yes, I would consider that since ARod is "tainted goods" it would constitute him not being "marketable".
 
I think its great if they can do it. Continuing to reward this dick for milestones he wouldn't have reached without cheating is pathetic.
 
Agreed, there is a spectrum of "help".... He is on the slimmest margin side for sure. But the union will also be considering precedents, and we can't ignore those. They can't call into question an entire class of potential compensation contract terms. Not saying it can't be done with some narrow language, but the union is going to err on the side if the players.

Now what right a team has to the marketability to an individual....that also gets into the finer points of his contract. Which by the way, I'd love to read that document.

Arbitration sounds about right assuming he doesn't push this into the courts. As you say, the PED system is a work in progress. Not only do they need to refine what is a "crime", the also need to refine " punishment" including damages to teams that made investments in the players. In the real world, employees are liable for damages brought to their employers due to illegal acts, just that most times the people committing acts of stupidity can't pay. ARod is a different animal.
 
If I'm A-Rods lawyer I convince A-Rod to give the bonus to charity.
 
The Yankees have to get that guy in the rearview mirror because looking through the windshield in April and May here's what they will see. Toronto, Boston, Baltimore, and Kansas City: 3 home/3 away each team.
Tampa: 3 Home/7 Away,
Detroit: 4 Away,
Mets: 3 Home,
Washington: 2 Away,
Texas: 3 Home,
Oakland: 4 Away
 
Nothing says he has to get the ABs to achieve those milestones anyway.

But I'd still like to see him gone. Treat it like the Pavano money (well 50% bigger)...my guess is they wait partway through ST. If he sucks, try to get him to retire and settle up, leveraging insurance. Otherwise he is outright released. No way Steinbrenner should let this guy don pinstripes in YS ever again.
 
On the Yankee end they never should've signed Arod to that contract when he opted out and then basically went crawling back. On Arod's end things would be a lot better for him if he just took his suspension instead of putting on that three ring circus. On one end you have Arod and on the other you have proof of how friggin moronic the Yankee organization has become.
 
...I don't think that eating ARod's $21 mil per year is out of the question...the Dodgers are already eating that much this year.
 
Yep, I'd love to see A-Roid not even make it out of ST.

PS: It's good to see the Bums eliminating dead weight, tho' they gotta' eat some contract money, like most of Kemps if not all. But then I wish the Yanx would do the same with A-Roid, if Tex does not come around by the mid or end of May, DFA him. Fok the money.

Honestly I don't see how A-Roid can ever play any position, and I doubt he can hit .200 at his best, then DFA him, even if it means eating his bloated contract.

Like Vick said, the Yanx screwed themselves on Alex, tho' they had no clue what was to come....!

Hammer, when you go to a Yanx game this year, do you think you can rent a NYPD outfit to cuff and put Alex in the trunk of your car. Create your own Warrant for him......to get him out of the park.....!!!????

BTW-rent a car under a false ID, and leave Alex in the trunk too....!

Catfish on all those roids.......you'd have Ricardo down for a noddlin session for sure.
 
I never met a true Cajun Noodler, who was not missing at least one finger, seriously. And to think a few of those Cajun's thought I was stupid enough, like them, to get in Gator and Water Moccasin infested waters. The Snapping Turtles down there get up b/t 200-300 lbs. The Catfish, usually 50-90 lbs.

It takes two men to usually pull up a 50+ lb'r. It takes a dozen to bring up a 100 lb'r, as that's only 10 fingers amongst them.

However in many Southern States in Reservoirs near the gates of damns, when using down riggers, I've read quit a few stories in Field and Stream, where several men, would park on top of those gates, keep the Outboard running, to escape a whirlpool, (due to the open gates), while pulling up as big as 300-400 lb Catfish. One guy brought but 4 Catfish home, and prior to gutting had 1,300 lbs of Fish.
