Cisco wasn't a victim. Nor was he intending to " cheat", I think there are levels to this issue.

There are guys that take take something benign and it turns out spiked. This was very common with supplements before 2007.
There are guys that seek professional help and get taken by con's....Cervelli in this camp. Biogenesis/Balco (unaware)
Guys looking to recover from injury and testing the limits....Petite here.
Guys that know things aren't up and up, but believe it can't be detected. Giambi, Sheffield Bonds ARod. Biogenesis/Balcony ( fully aware).
Guys intentionally cheating including fake prescriptions and related felonies. ARod, Canseco.

Records show from Balco not everyone knew what exactly they were taking. Its assumed Biogenesis was similar given the fake Medical degree.

Anyway I think suspensions should be classified by level of intent. 10 games to lifetime bans running this range.

Do you know the man personally? how the the do you know what his intent was? Whose making assumptions now?

...every player received a PEDs list of things that are not allowed, period.

...Cervelli, knowing the penalty, intent or not, decided to do it anyway, period.

...and under the terms of the CBA agreement, which his own Union ratified, he was suspended, period.



...if you want to assert that you think the rules are unfair, that's fine...but like I've explained before, this is not applicable to conventional law. Baseball is governed by its own rules and MLB and the MLBPA hammered out an agreement that the players voted on...everyone involved knew the rules before they decided to turn to a quack working secretly out of a strip mall.
...and as far as I know, no one in MLB or the MLBPA thinks Cervelli or any of the others were unjustly treated.
