Previous point that you had quoted mentioned that Argento and her victim:

Argento and Weinstein dated for several years after. If this is the barometer for whether or not rape happened, then we can infer that Weinstein did not rape Argento.
Argento has no case against Weinstein now...that's been established...I'm sure he's thrilled

It is in many places already...and in California, I'd say yes....17 year olds are not that different from 18 year olds in many cases...at 17 I was sexually active...laws can be tricky....oral sex is illegal in many states as is smoking pot or drinking alcohol....weirdly enough when I got back from the war I was too young to buy a beer in San Diego.....I still drank beer....in Europe this definitely would have been a non issue...especially italy

She's this morning claiming it was a black mail scheme ...never happened and Bourdain paid the kid to make it not mess up her cause with #metoo and Weinstein.....she said he's been harassing her and threatening her and Tony just paid the kid off to stop the tabloid....so...this all could be just gold digging after all...we don't know at this point but Bourdain gave the guy money to stop

...the issue in this case is not rape by force or under what situations a male might get a boner, it's about statutory rape.

This is gross exaggeration of the views posted here....and we'll all die , that's for sure....read the entire conversation or don't but cherry picking and sensationalizing things to make it seem we all are chuckling away at rape or pedophilia is just you trying to avoid the conversation...I've included the possibilities that she may have raped him...she also may not have raped him...maybe add your opinion to the topic and consider what's actually being said here...big difference between I got a scratch on my car and my car was totaled....ignore anybody you like but own it if you address them. Nobody makes you take interest in personal opinions or experiences but yourself....often topics and questions about them contain personal experiences...not being able to have those conversations is what should die..is the kid a victim or a blackmailing liar...is she guilty or innocent....these are questions threads are created for in order to discuss...you can discuss them or be disgusted by them...choices

well she said he wasn't a victim and it was blackmail...and Bourdain wrote his own story...he made his own choice like an independent millionaire supporter of feminism would right? Bourdain is not a victim here of anything but his own poor choices if even that was his reason..in the end we don't know what makes someone do that ...if he can kick a heroin addiction he can handle getting dumped by his girlfriend

we just don't know....Bourdain was never called evil by me...I watched his show many times with the wife....both of us noticed he is a heavy drinker ..when he offed himself my first thought was booze...depression....you though think this girlfriend made him end his life....I don't know that to be true at all but even so should have no bearing on feminism and what those concerns are..I don't think Bourdain is a victim of anything but his own bad choices. Maybe he was mentally ill.....suffering a health condition..or just bored ..shooting pool with a rope...we'll never know but he has his own child...who I think is the victim in his case

Her cheating doesn't seem like it would be enough to make him kill himself, but that with the fact that he covered up her rape of a 17 year old (if that is what happened), along with his predilection for booze and drugs, having driven him into a deep depression, seems like it would have done the trick. It makes sense.

But, these are assumptions. We can't truly know. If she did have sexual relations with Jimmy B while he was 17, and in the state of California, then she commited statuary rape. Regardless of if Jimmy's career died and he needed money, and used a card he had been keeping in his pocket. She is guility and paid him off because of it.

It is possible it never happened and Jimmy's career died and he became desperate and made a false claim against Argento to blackmail her. He did sue his parents for money as well. That Bourdain saw that such a claim even being false, would destroy Argento, her career, and maybe his reputation. Though it makes more sense that it happened, again these are assumptions. We probably will never know for sure.

If she slept with the kid when he was 17, she broke the law and she should be punished.

If she didn't sleep with the kid and he has been blackmailing, he broke the law and he should be punished.

I don't think it's fair to say this discussion has made light of rape...in my case it's questioned the circumstances...to discuss this issue and be sensitive to the possibilities it's important to point out the extenuating circumstances of the age of the young man and the relationship he had with her....make no mistake...she's guilty of breaking the statutory rape law of California...the drunk cougar doesn't get a pass but rape victims taking large sums of hush money raise questions...I see nothing wrong with addressing those points...if anyone is offended by my personal recollections...that's on them but as I've said...when I read the story I tried to put myself in this guy's shoes at that age and certain things didn't add up to non consensual rape....even with the law as it stands...this case is not your standard no means no rape case from what I've read and if it was....why take the buyout and still have a positive relationship with the lady? Where were the parents? This kid was wealthy and had access to top notch legal council...these topics are fair game for discussion....I'll say one thing...I now do not believe that Asia is credible to speak for the #metoo movement..in fact, she's just boosted Weinstein's defense case.maybe the guy is traumatized for all these years and she killed his career...I'm as open to that being a reality as I am to him this long after the fact taking her to task when the money ran out....as to Bourdain...he took the coward's path in my view...I don't buy that this actress ruined his life...he had options...if anything, alcohol and depression ruined his life...
People under the age of 25 do not have fully formed brains. They make mistakes because they are young and confused.

That being said, it's vey hard for me to imagine myself at 17 having sex with a reasonably attractive older woman and not getting a lifetime of good memories out of it. When I was in my teens, a lady popped my cherry right before I went to war. She didn't want me to die without having done that. I was really too young to know what I was doing. Did I wind up with bad or good memories of that? What do you think? Yep, good memories.

All this means that it's hard for me to put myself in the youngster's position but if it were me, I'd have enjoyed it immensely.

What law would she be punished under? There's no law that would punish her after this amount of time. All he can do is expose her to the public.

Asia Argento says she did not have sex with then 17-year-old Jimmy Bennett, but a photo and various text messages between Argento and a friend tell a very different story ... she flat-out says she had sex with him.

This is one of 4 photos Bennett, now 22, took in a Marina del Rey hotel room back in 2013. The then 37-year-old Argento and Bennett are on a bed shirtless, their heads on a pillow and their arms entangled. Sources tell TMZ the pic was taken after the 2 had intercourse. It's a crime in California for an adult to have sex with a person under 18.

Bennett later threatened legal action and, in April, Argento settled with him for $380,000 ... which her boyfriend, Anthony Bourdain, paid.
Argento released a statement Tuesday, saying, "I have never had any sexual relationship with Bennett."
 
What law would she be punished under? There's no law that would punish her after this amount of time. All he can do is expose her to the public.
