I would want them to be charged with the strongest charge that actually had a reasonable chance of conviction. There's no value to charging them with 1st degree if they end up acquitted.
You think family of a murder victim will act with "reason"? Especially with that murder being broadcast on every news network 24/7 for a week? Put yourself in their shoes.

There's an old saying, "know your audience", and he both knew his audience (other white nutbars) and didn't (non nutbar whites and non nutbar POC).

It is insane to think that one life is more valuable than another. And that the punishment for murder should be more lenient if the victim had priors. Wtf. This is exactly the kind of subtle institutional racism that is ruining this country.

You went the wrong way with that. What I was asking was if the cop or accused has a history of violence or anything, can the degree change. I was not speaking of whether the victim had a history. Its been noted( I didn't fact check) that this cop has had double digit complains of abuse of force and racial tendancies or something.

Can that play a factor into the cops intent and this change the degree of the charge?

I was not speaking about the victim or his prior history. A cop likely wont know prior history until after the incident has developed in an arrest like this anyhow.

Some do act with reason. Some tend toward forgiveness. Some tend toward vengeance. Some tend toward opportunism. Every family is different. Every situation is different. I can't legitimately "put myself in their shoes" because each person's life experience and world view varies from another. I can only speak based on my own experience and world view.

Based on my own experience and world view, it is foolhardy to demand something that is unlikely to occur.

They would need to build more jails to arrest all those people and hold them for 10 years. Would be a dream scenario for privately owned jails.
