Caron Nazario was driving his brand new SUV through the town of Windsor last December when he saw a police cruiser signal for him to pull over.
The Army second lieutenant slowed down on U.S. Route 460, flipped on his turn signal, and looked for a lighted place to pull over because it was dark outside, according to a lawsuit filed last week in U.S. District Court in Norfolk.
Less than a mile away, Nazario saw a BP gas station. He drove his Chevrolet Tahoe into the parking area and stopped, the lawsuit said.
In the meantime, Windsor Police Officer Daniel Crocker radioed he was attempting to pull over a vehicle with no rear license plate and tinted windows. He said the driver was “eluding police” and he considered it a “high-risk traffic stop,” according to a report he submitted afterward and was included in the court filing. The written report acknowledged, however, that the SUV was traveling at a low rate of speed.
Another officer, Joe Gutierrez, was driving by when he heard Crocker’s call, saw him attempting to pull the vehicle over, and decided to join the traffic stop. What happened after that has been disputed by the officers and Nazario.
But the police officers’ own body cam footage — and a cellphone recording made by Nazario — back up the Army lieutenant’s version of events, according to his attorney, Jonathan Arthur of Richmond.
“It’s all right there in the footage,” the attorney said.
Arthur said the lawsuit was filed in federal court because it alleges Nazario’s constitutional rights were violated. Windsor Police Chief Rodney “Dan” Riddle did not respond to a request for comment.
Windsor is a small town in Isle of Wight County, with a population of just 2,700. Crocker and Gutierrez still work for the department, according to the town manager, and are the only named defendants in the lawsuit. Neither could be reached for comment.
According to the lawsuit, when the two officers got out, they immediately drew their guns and pointed them at Nazario — who is Black and Latino and was dressed in uniform — as he sat in his SUV.
And while Crocker had radioed he was pulling the vehicle over for not having a license plate, his body cam showed there was a cardboard license plate typically used on new cars posted in the rear window, the complaint says.
The officers shouted conflicting orders at Nazario, telling him to put his hands out the window while also telling him to open the door and get out, the lawsuit says. At one point, Gutierrez told Nazario he was “fixin’ to ride the lightning,” a reference to the electric chair, according to the claim.
Nazario repeatedly asked what was going on but got no response. Frightened and unsure what to do, he told the officers he was scared to get out.
Gutierrez then responded, “Yeah, you should be,” the complaint said.
The officers then attempted to pull Nazario out of the vehicle. When the 27-year-old asked that they call a police supervisor, Gutierrez stepped back and pepper sprayed Nazario multiple times, the lawsuit says.
The chemical temporarily blinded Nazario and caused a burning sensation in his lungs, throat and skin. Nazario’s dog was in a crate in the back and also started to choke.
Nazario got out of the vehicle and again asked for a supervisor. Gutierrez responded with “knee-strikes” to his legs, knocking him to the ground, the lawsuit says. The two officers struck him multiple times, then handcuffed and interrogated him, the complaint says.
Gutierrez wrote in his report that his body cam video stopped recording when it was compressed between him and Nazario during a struggle.
Crocker opened the windows and tailgate of the SUV after Nazario expressed concern about his dog.
When Nazario told the officers he waited to pull over until he could get to a well-lit area, Gutierrez said that was “reasonable,” the claim states. The officer also said it “happens all the time” and that “80% of the time it is a minority” who waits to get to a lit area.
Gutierrez told Nazario the problem was that he refused to exit the vehicle, according to the claim, and threatened to charge him with obstructing justice, eluding police and assaulting a law enforcement officer.
“Realizing that they had acted illegally,” the lawsuit says, the officers told Nazario that if he “would chill and let this go,” they would release him without filing any charges. But if he fought it, which Gutierrez acknowledged he had the right to do, Nazario would be charged and would have “to go to court and notify his command.”
Afterwards, the two officers filed reports with “near identical” misstatements, the lawsuit says.
They reported that Nazario refused to show his hands and slapped theirs away when they tried to get him out. Gutierrez wrote that he gave knee strikes to Nazario’s legs because he wouldn’t get on the ground and resisted arrest.
Medics were called and treated Nazario at the scene. The police chief also came and was briefed as to what happened, the report said.
Gutierrez wrote in his report that he felt he had two options: charge Nazario with obstruction, eluding, and assaulting an officer, or release him without any charges.
“I made the decision to release him without any charges,” his report said. “The reason for this decision is simple; the military is the only place where double jeopardy applies. Meaning that whatever happened in civil court, the military could still take action against him. Being a military veteran, I did not want to see his career ruined over one erroneous decision.”
Crocker’s report also states that he chose not to file any charges because Nazario was active duty military, up for promotion, and the officer didn’t want to see his career ruined for “poor judgment.”
The lawsuit argues the officers didn’t have probable cause to charge Nazario with any crimes, the stop was illegal and that the officers threatened to ruin the Army officer’s military career to cover their own misdeeds.

When I was 18 I was seriously mistreated by a Portland policeman and he threatened to take me to jail unless I apologized for telling him, when he asked where I was going as I got out of a Rose's parking lot, that I was going to the restaurant to eat. I'll never forget that son of a bitch.

All the law enforcement outrages that have occurred, police on trial for murder, national demands for justice reform and the cops just don’t understand why so many Americans have turned against them. Maybe because they are too stupid....or arrogant.... to learn??? The hits just keep coming. What rocks do we keep finding these scumbags under??? And they still want our understanding and support.........fuck ‘em all.

There are good cops. But, the shitbags like those above keep showing themselves again and again. It seems there are fewer and fewer "good" cops every day and more and more testerone fueled ex military dudes behind the badge who are out for violence or angry racist fuckers who think they are above the law and can get away with their bullshit. Fact is its getting harder and harder for them to get away with it because someone is always watching now whether it's their own body cams or civilians filming on their phones. But, that there are so many of these shitbags, has stained and continues to stain the good officers in the department.
I am glad to hear that some places have made laws now where officers must report their partners for excessive force and other bad apple shit. It's a move in the right direction. More and more bodycams means more accountability as well. There is still clearly a long way to go.

Back in 1974 I was in the navy in San Diego. a bunch of my buddies and I were heading east to do some camping when a cop pulled us over for absolutely NO reason that we could figure out. But the cop made it very clear, very quickly. My friend who was driving was Native American.....and the rest of us were a bunch of pasty faced white boys. The first question the cop asked my friend was where he was from and what his ethnicity was. We were flabbergasted but Fred was used to it. He just smiled and said, “I’m Aleut Indian from Akutan Alaska.” The cop was so befuddled he had to ask him twice more, as he had apparently never heard of the Aleuts or Akutan Alaska. It just totally hung him up. He thought he was going to round up a wetback and he got punked instead. He was so deflated the rest us us started mouthing off, asking him if he wanted to know our ancestry and where we were from. All he could do was threaten to run us in for disorderly conduct and told us to get our asses out of there. Just another cop looking for trouble just because he could......

I kept expecting the police to tell him that he matched the description of someone who just committed a robbery or murder, something to justify guns being drawn on him.

And if there's any attempt to reform the police department, to add accountability and standards, the police union will fight it tooth and claw. Yet somehow the whole police force shouldn't be tainted by these individuals that the whole force protects.

Years ago when I was young, early 2000s, I got beat up and thrown in the drunk tank by some cops, for finishing my beer from the bar on the sidewalk. It was before cell phone camera days but they only relented when someone with a video camera showed up and and started yelling "they are Rodney Kinging this fool". All I could do was yell "help, I am not resisting" while it was happening. After the incident I was handcuffed and thrown in a cop car for awhile, the initial cop who started it got into the front seat of the cop car just to power trip and ask me "how do you like me now", at which point I told him to go fuck his sister. I asked him for his name and he laughed at me. I asked everyone for his name over and over and was only told it would be on the police report, but when you get thrown in the drunk tank for nothing there is no police report, and when I asked for it on my release the drunk tank cops said they had no idea who even brought me in.

I had a very similar experience 10-12 years ago. It was a Friday the 13th and the cops were doing a sweep. I was sober as a judge but still got hauled in by a very arrogant (and certifiably incompetent) buffoon. They never charged me and turned me out on the street at 3 am. Cost me $400 in car retrieval fees. My sister in law was a former Assistant DA for the county and she made some inquiries after it was all said and done. All she got was a bunch of cops playing (I assume) stupid. From that point on I stopped giving the police the benefit of the doubt, regardless of the situation......badges are shields for abuse.

Thanks, but at this point in my life its just a good story of my wild years and the only story which I got to ride in a paddywagon. No lasting damage other than my deep seeded distrust of police officers now.

I got a breathalizer at the drunk tank. 0.06%, still legally sober enough to drive. The incident that started it all was my sitting next to the wall by the bar drinking a beer discreetly from a bottle, he came over talked shit to me, got in my face chest to chest with me (even though Im 6'3 and hes probably 5'7) and told me I had 2 seconds to get out of his face. I said ok, turned around and thats when he took me down from behind and the other 4 saw jumped in from there. Other than drinking a beer my only crime was not taking him seriously until he bumped chests with me, then I was shocked and scared. It was a total power trip, he just wanted to show me who was boss.
One funny side note to the whole story was that it turned out that one of the guys in my paddywagon worked with me. We bumped into eachother a few weeks later on the elevator and both just stared at eachother for like 10 seconds before we both just busted up laughing.
Edit: I felt like I should clarify that the other cops were not beating me up, they were assisting in the take down and had my limbs pinned down. The original cop was the one cuffing me, and he cuff'd me in a way that jammed 5 fingers, including both thumbs and I thought one was broke, I also had bruises up and down my backside rib cage where he was grinding elbows and knees into me, I had some scrapes on the front side because when he took me down it was armtwisted and leg swept so I went down hard and fast on the sidewalk.

It’s probably been 30 years, but when we lived in our last house we were very good friends with a group of neighbors who all lived within a half block of us. We all had work schedules that pretty much gave us Fridays off, and in the good weather we’d all get out early to get our yard work done together so we could hang out, drink beer and play volleyball. We also had a big, ugly white feral cat that terrorized the neighborhood cats and cost us a fortune in vet bills. So anytime I saw it I was taking shots at it with my BB gun. One sunny Friday afternoon we were all out working in our yards when I saw the white cat stroll brazenly by and flip me the paw. So I ran and got my BB gun and started stalking him through the immediate vicinity. As I was doing so I heard a car turn the corner behind me. Call in sixth sense, but I just KNEW it was a cop. Sure enough, I heard him hit the brakes hard and I couldn’t put that BB gun down fast enough and show my hands. The neighbors thought it was hilarious and the cop was very cool, but I came close to literally loosing my bowels. It was scary, and even back then I wondered how it might have gone down if I hadn’t been a pasty faced white boy. And if anything ever got that freakin’ cat, it was either old age or a coyote.....
