They're talking about building a case for abuse. They're including something like verbal abuse to help build the case. I don't see why this is such a big deal.

In Oregon we had a cult intentionally try to poison people with salmonella. We didn't have a law that says you can't intentionally give people salmonella yet those people were all tried and convicted.

That's the entire point. You just gave a lawyer an argument to make because you were too dumb to differentiate between 7 bad cases and 500 other hooker cases.That's for greater legal minds than us to figure out. The penalty for speeding is a ticket, but you can still be charged with murder if you run someone over someone intentionally while speeding, manslaughter if you do it unintentionally.

Liked today's dumbest post. I always doThe max penalty if they are CHARGED with that. They can still be charged with other crimes. The penalty for a crime you're not charged with doesn't change the penalty of the crime you are convicted of.
Also you can be convicted over more than one crime but your prison sentence isn't based on the term of the lowest crime you are convicted of.

You think some DA is going to charge a guy with basic assault or some other crime for this situation and his lawyer won't use this law as a defense? Get real. This is the new limit. So dumbIn the cult poisoning case I mentioned they were charged with attempted murder, even if there was a salmonella law on the books and the penalty was 6 months it wouldn't change anything. The attorney could argue that all he wants, if convicted of both crimes the person would not be given only the penalty of the lesser crime they were convicted of.

What's dumb is that it isn't even remotely similar. Those are two different crimes by law. Now the HIV infection is one crime. With one max sentence. There is no other crime unless you give someone HIV and then shoot them or something.What was dumb about it? You kill a security guard shoplifting from a store you will be charged with shoplifting and murder. If you are convicted of both you will do many many years in prison. It doesn't matter if the max penalty for shoplifting is 6 months.
