Effectively, The Blazers Have Now Handed Miles A Potential Lawsuit?

I always considered Miles a waste of time - as a player. I never had a darn thing against him as a human being. This situation, however, is starting to strain my better nature.

The medical retirement didn't cost Miles a dime. The Blazers still paid him his inflated salary. The only reason for him to risk serious, permanent disablity is some kind of misguided malice against the team. Lord help me, but at this point I hope the jerk-off hurts himself so badly he winds up having the leg amputated!

And please, don't tell me this fake comeback is about his "love of the game." Miles never gave 2 hoots about basketball. If he had any love for the game, he would have made some effort to develop his potential.
 
Miles has to show he has damage to actually be awarded anything in a lawsuit. He's still making $9 million a year. He would have to prove someone would sign him to a contract worth more than that to have an actual damages.

Very unlikely considering he is signing for vet minimum and that just comes out of what insurance has to pay him on his Blazer's K.

That Miles signed with Memphis is legally irrelevant to the Blazers and actually helps Miles case. He can say he might have received better offers from other teams..

Yeah, he may have received better offers from other teams had he not signed the worst contract available to him literally within hours of the email being sent. :ohno:
 
all that email the blazers sent did was give a lot of people a good giggle. miles has about as much chance of success in a lawsuit against the blazers as the blazers do of going through with their kindergarten-level email threat.
 
I've noticed that every single media outlet has simplified it down to "if you sign Miles we will sue you". That's not what happened. We said "if you sign Miles with the intent to harm the Portland Trail Blazers, we will sue you." Once again the media can't read... or write.

Of course the Blazers aren't going to say we are going to sue anyone who signs Miles.

But that email was so poorly written it wreaked of implied threat so much that any unbias reading will conclude that the email comes across as a threat.

I don't think it is all a media thing as the way the email was written.
 
Man, it is amazing what people don't know about the law and the American legal system.

It is also amazing the sheer amount of "declarations of fact" from posters who have no legal experience. Of course that it because people with legal experience typically understand that "it depends."

The Blazers helped Miles get a job.

The Blazers dared anyone in the league to hire Miles, and a team did right away . . . with other teams ready to sign if Memephis didn't (IMO).

Miles should be thanking the Blazers right now . . . he gets 9 mil/yr from the Blazers and every team is checking him out right now wondering if he is good to go. His agent couldn't even dream of getting his client the attention that email did

My question is if the Blazers get a finding fee?

PA and Larry Miller are not assholes. I think PA has all the right to do what ever it would takes to stop or let scumbag owners/GM's not try to stick it to us for millions in luxury tax when they are not living by the spirit of the rules. I wish the Blazers wouldn't have sent the email but it is PA's right to do what he thinks is best for his investment/team. You can call me an asshole or whatever it doesn't bother me. PA will backup what he emailed and if Memphis only plays Miles 2-3 games for just a couple minutes and cuts him after one 10 day contract I'm sure the Blazers will take legal action against Memphis, the NBA and maybe more. If you don't like it that is ok but if you have invested millions then you could be the one that sits and does nothing about being shafted.

I'm curious. I don't claim to be correct all the time, but in an area where I have some formal training and a bit of experience I prefer to listen to those who do, too.

If OMG corrected me? Then I might listen. I don't think I'm too impressed by your knowledge of the legal system, though, so I'm gonna go with my opinion here.

Note: because "Drink Your Milkshake" was not impressed with my education thusfar, I have decided to give up my legal career and will not be attending class today. After all, if my legal resume and the fact that I have more legal experience than the vast majority of the population cannot serve to impress a poster on a forum, then what good is it? Really?

Give a man a fish and he will eat for a day, teach a man to fish and he can feed his own damn self. Try to teach Drink your Milkshake to fish and he'll rip the largemouth bass from your hands and start fapping with it.

He just was picked up on another 10-day contract and he still is owed $18 million over the next two years....

Yeah, he has really been negatively impacted by that email....which BTW never implicitly told other teams not to sign Miles...just not to sign him with the SOLE INTENT to harm the Blazers financially......Think hard about that, there is a difference there....
 
The fact that Miles was able to sign a contract later that same day makes Miles' case against the blazers rather weak.

Lawsuits prove intent every day - evidence would include their actions, depositions, internal emails, statements made, etc. It's not that hard to do really.

How do the Blazers' KNOW another team's intent? What would be their basis for filing a lawsuit?
 
The NBA handed Miles a lawsuit by nixing the waiver claim by the Blazers.

Miles would have had a guaranteed contract for the rest of the season; now he only has a 10-day deal.
