From what I remembered reading, the Statute of limitations applies on first discovery. Meaning, the statute starts the moment investigation of that crime is in the works.So the problem with Flynn is not that he in fact lied and he clearly did, but instead how he was proven to be a liar.
Besides, from what I understand, the case is not only inactive, it's also well outside the statute oof limitations.
example: Hillary’s “Benghazi” possible crime has already passed statute of limitations because the discover of that crime was past that time frame. In the FBI case, there has never been a formal investigation of these crimes until last year.
