By the way Fed Ex drivers going 45 in my neighborhood drive me insane.

I may have been the guy who flipped out on him except I think I'd just call him a stupid mother fucker and scream there's kids in this neighborhood.

I don't know how they get away with driving so fast. Without googling it I bet that if they do have some gps trackers on those trucks they know how to rig them.

I will say this, if you're on the job and you're driving, if someone yells at you to slow down, you don't stop the truck to have an argument. You just wave and keep going. There was no reason to engage with the guy in the first place.

What's funny is that if the roles were reversed and a black guy took a swing at an elderly white guy, I can guarantee that Maris would say the guy was totally within his rights to shoot him.

A FedEx delivery driver who punched a man who shouted racial slurs at him will not face criminal charges after the man later died, officials announced.

Timothy Warren was driving his truck through a Portland, Oregon, neighbourhood when Joseph Magnuson began to shout at him to tell him that he was going too fast.

Mr Warren stopped his truck and tried to explain to Mr Magnuson that he was exhausted and just wanted to finish his work.


But Mr Magunson did not stop shouting and began hurling racist insults at him.

Mr Warren, who is black, stepped out of the truck and both men shouted at one another.

Mr Magnuson went to punch Mr Warren, who then punched back and hit Mr Magnuson's left eye.

The 55-year-old man then fell to the ground and briefly lost consciousness. He died later that evening.

Prosecutors have decided not to charge Mr Warren with a crime.

He did not intend to kill Mr Magnuson and acted in self-defence during the incident on 26 September, the Multnomah County District Attorney's Office said in a memo.

Mr Magnuson's death from the fall was precipitated by “extremely poor health,” a medical examiner concluded and the punch itself was not fatal, Senior Deputy District Attorney Adam Gibbs wrote.

Mr Warren was within his legal right to challenge Mr Magnuson's “racist vitriol,” Mr Gibbs noted. He said Warren's decision to confront Mr Magnuson - rather than ignore him - was not legally significant.

Oregon law does not carry a “duty to retreat” provision that would have required Warren to reasonably remove himself from danger, Mr Gibbs wrote.

Prosecutors and police pieced together events using accounts from six eyewitnesses, three of whom saw the entire incident. They all maintained that Mr Warren had driven at an acceptable speed and that Mr Magnuson started the incident, and then escalated it.

“Mr Magnuson's actions, as reported by all three witnesses and Mr Warren, gave rise to a reasonable belief on Mr Warren's part that a limited use of force was necessary to prevent injury to himself,” Mr Gibbs wrote.

I have no love for the FedEx driver. He should have apologized. The "I'm exhausted" bullshit excuse just means you admit you are going too fast and were doing it on purpose. I hate those fuckers driving those huge trucks so fast.

See it all the time. That has nothing to do with race.

The 55 year old guy shouldn't have tried to punch him and he'd still be alive.

The important part is that there is no way a jury would convict the guy.... No need to waste money on a trial.

Well what do we know?
First, the guy was yelling racial slurs as witnessed by 6 different witnesses
2nd) The guy threw the first punch thus starting the incident as witnessed by several witnesses
3rd) The guy was hit, fell and died. He was also considered to be in very poor health which likely contributed to his death.

There is no mention of a kiss. I can't imagine that was his reason for getting out of his truck and coming to the ole boy.

I will repeat that I think FEDEX should teach their drivers not to engage with people in this kind of scenario. Frankly it’s unprofessional and the guy hadn’t started yelling racist stuff until the driver stopped to talk to him. Shoot, when people yell at me to slow down I just give them the bird and keep on driving.
 
FedEx's only marketable feature is being a hair faster USPS and UPS.

Since all three use the same technology and manpower, cheating traffic laws is the only edge that keeps FedEx in competition.

The drivers are hired for their aggressive behavior, and they will certainly display it if you ever challenge their right to drive dangerously.

Driver initiated threat by endangering man's neighborhood.

Driver escalated threat by exiting vehicle and arguing with man, despite being in the wrong.

Looks like the DA hid this from the public in order to give FedEx time to buy witness "cooperation" between all parties, and iron out any grievances with the man's relatives if any exist.

I'd love to hear your reasoning for him to exit the safety of his vehicle if it wasn't to escalate the situation, which he obviously did.

It says in the article. He got out to talk to the guy. To explain he was tired and trying to finish his shift. The guy wouldn't listen to reason. He kept yelling racial slurs and threw the first punch.

Gets out and says "my bad I didn't realize how fast I was going" calms the situation IF you feel the need to get out in the first place.

But he gets out and basically makes a lame excuse and it pissed the other guy off more. Next time you're on a road trip and have to go to the bathroom tell the cop that's why you were going 130mph. Won't work.

The driver may be a total dick wanting to fight...if he didn't break the law you don't charge him.

Playing if only he hadn't done so and so is a slippery slope.

That said, if the white guy calling him n something had taunted him into throwing a punch and he killed the black guy I'd expect the same decision.

It doesn't calm the situation if the other guy is a raging racist. The driver apoligized and the other guy kept yelling racial slurs. He threw a punch. So the driver defended himself. The guys death is on himself. You can't fix stupid.
