Federal judge: 'You're not allowed to record cops'

Part of the problem is that many states have laws that allow photos in public - but not audio recordings. The latter is deemed an invasion of privacy. Have a cell phone that records both? Welcome to a world where technology moves faster than the law can keep up.

I'm not familiar with the facts of this particular case, but it wouldn't surprise me if that was a key issue.
 
Sadly, that article doesn't really help. The part about announcing what you are doing is an argument you hear in AUDIO recording cases. (if the cops know what you are doing, they can't invoke a law intended to prevent HIDDEN wiretaps) The author doesn't actually clarify that distinction.

I can't tell if the author doesn't get it - or if the judge applied the wrong law! Either way, the statutes need to be changed to reflect changes in the real world.
 
If the police can record you in public, you should be able to record them in public. If anything, the government should be held to a higher standard of conduct.

Why don't you send a letter to Wyden and ask him to fix this. Make a it a multi signature letter with everyone on S2 and a where ever you can get signatures.
This needs to be corrected. There should be a publicly available recording available after every one of the excessive force encounter. Excessive force is dam near always the case when the cop shoots a person. Sometimes even when he is taking fire, because they provoke the incident and should stop the practice.

I wonder what would happen if you wore a body camera similar to what some police wear? So you weren't recording the police, you were recording everything you encounter.

Also I'm free to record the police all I want, all I have to do is show them my Blazer Press Pass. That makes me a member of the media, which according to that judge gives me more rights and freedoms than you peons.
