No one else has a problem that police can detain you over a candy wrapper and a cartoon character laugh?

Not only does that seem subjective, it's like the cops came up with that by watching Harold and Kumar.
 
If testing indicates the person is high, the officer questions the person and tries to get him or her to crack. Some do, some don't.

Officer: Are you high?
Suspect: No
O: You sure?
S: Yes I'm sure
O: So you're not high?
S: No
O: And you are sure about this?
S: Yes

They need to call in all the SWAT gear. Just in case.

Ah yes, Riverman indeed brings up a brilliant point. The police are overlooking the vehicles in these situations for sure. One cannot be sure some one is stoned based off of candy bar-ism and buttheaditis alone.


You can always spot the stoner by his/her trademark vehicle.

Not anymore. That bus in your pic is a 21 window microbus in great condition, worth between $75,000-125,000. I doubt many people in such a spendy ride will be stoned. Far more likely will be a 1994 Subaru with a sticker that cleverly states "world peas" and a driver side door in a non matching color.

No amount of marijuana will impair your judgement, reflexes and motor skills to the level that a .08 alcohol level will.
 
Wait... they conduct field sobriety tests? For weed? This was clearly the decision of someone who has no idea what marijuana does.
 
Why don't they just take a swab of your saliva? That's what police here do.

How well does that work? Can they tell the difference between someone who is high at that moment, was high four ours ago or got high the day prior.
 
How long can they be detected?

Cannabis: Random roadside drug testing can detect cannabis for at least several hours after use. Even after a small amount of cannabis you should not drive for at least five hours. Even though you may not feel the effects, the drug may still be detected in a test.

Methamphetamine ("speed", "ice") may be detected for at least 24 hours after use by random roadside drug testing. Note that the withdrawal effects of methamphetamine, such as fatigue, anxiety and irritability, can also lead to unsafe driving.

MDMA (ecstasy) may be detected for at least 24 hours after use by random roadside drug testing. Taking large doses, using other drugs at the same time, and even your own particular metabolism, can affect the length of time you will feel the effects of ecstasy.

I think it's in the way they word the laws. Basically they're not charging you with driving whilst under the influence of said drug; they're charging you with driving whilst having said drug in your system.

It's still a relatively new idea, so there's not a lot of info on it. From what I've gathered thc can only be successfully detected in saliva within around 4 hours of ingestion. Supposedly they are not very accurate and are easy to throw off.

Generally though if a saliva test comes back positive (barring a false positive) the officer can be sure that the suspect is under the influence, where a urine or hair test would inform the officer that the suspect has been under the influence in the past.

Thats Great. Meanwhile, Officer Dickhead is handcuffing, tazering and kicking the ribs of a legitimate citizen for the fun of it.
