The question is whether the government had reasonable proof of that before they raided Cohen’s office and subsequently compelled him to testify against Trump. Above my pay grade, but I would be willing to bet that issue comes into question when this whole stinky mess eventually gets litigated. If it does.

I might add that this raid was sanctioned by the deputy Attorney General of the United States government.

My thought, based on how I have seen the legal system work, is that, if this goes to court, Mr Trump’s attorneys will have a different take on the matter and that it won’t be “firmly settled” until the Supreme Court has ruled on it.

Anyhow, like I said, Trump's lawyers would be bucking a federal judge whose job is to approve or disapprove of search warrants plue the deputy Attorney General. Gonna be tough for Trump's lawyers to win that one. I'd say so tough that it's gonna be damn near impossible.
Also, Trump's lawyers don't have a good track record of winning cases outside the deep South.
