The IRS rule is key because companies with more than 50 full-time employees must provide health insurance under Obamacare, or be fined. Business groups have been warning that small companies might try to replace full-time workers with part-time help to avoid being forced to offer health insurance in 2014, but the 30-hour full-time definition is likely to undermine those plans.

Employment has been considered 30 hours a week, minimum, for many things and in many places.

They had this rule in Hawaii when I lived there. If you paid a worker 30+ hours a week, you had to provide health insurance. The sheer number of workers, UNION and otherwise, who accepted cash in lieu of a traceable paycheck was downright amazing.

That was a state law. Hawaii can call it 10 hours a week if they want, that's their prerogative so long as their citizens agree to it.

Federal law has now been changed from 40 to 30, as this is a federal tax plan, and the taxes go to the federal government. That is the point. Plus, this wasn't a part of the original bill, and hasn't been voted on by Congress.
 
If it were 40, the employers would work them 39.5.

They're doing what they can to stick it to people. It's not hard to figure out.

The Fair Labor Standards Act (FLSA) does not define full-time employment or part-time employment. This is a matter generally to be determined by the employer. Whether an employee is considered full-time or part-time does not change the application of the FLSA.

40 hours a week was defined in this law as being "full-time". It has now been changed by the IRS to 30 hours.
