If you find somebody who has broken into your home, with his/her back to you, rooting through, say your filing cabinet.....should you have the right to shoot, even kill, said intruder without fear of prosecution of any degree?

Depends on whether the intruder is your mom or not.

I see your point. I had forgotten how much you hate your mom.

Sorry, I meant your mom. She's always breaking into my house.

Yes.

But once they're down, flip 'em over and put one in the chest so it looks better in court.

Actually, I think that's the first thing I've ever agreed with you on. I like your thinking on that one.

I don't know the legalities, but if someone breaks into a house, I think they've kind of given up some "rights".

that is not to say you can tie them up, make them into a sex slave and eventually cut off their skin and wear it like a bath robe. Unless they're into that kind of thing.

Unless invited, stay the fuck out of MY home if you don't want to get shot

In most places the legalities are this. If they don't pose a threat to you, you will be in trouble for shooting them.

Her fires back hitting one in the head while the shooter fled like a coward. Came back and got another gun and shot the kid on the ground 5 more times claiming he was moving and reaching for something. While the law says it was excessive and murder, I say he did the entire community a favor by ridding it of trash

Has HCP read this thread yet?

If you are going to shoot someone in your house, you will need to be prepared to convince the police that you truly believed that your life was in danger. If you believe that, and the person is in your house uninvited, save us all the money of putting them on trial.

Unfortunately, the shooter will then waste the taxpayers' money by being forced to trial and probably get jail time.

Hmm, very good question. My on hand ready gun is a Mossberg home defender. The 45 colt is in the bed room. So if I am entering the house and grab the shotgun, I would like to make sure that I dont harm the big screen, make a mess on the sectional....I think that just chambering the shell would make who ever shit their pants. Get into a position that if any resistance was offered, I would unload.

Having killed lots of critters in my life, I'm pretty sure I'd be willing to shoot and kill. But it wouldn't be my first instinct. I use a 12 gauge for home protection, so in such an instance it'd be pretty easy to take out his legs.

To be honest, though, I'd just point the gun at him and have the wife call the cops. Killing or even seriously maiming someone when there's no immediate threat to my own life may be legal and even ethical, but it's not something I'd want to live with. I've shot deer that hadn't died instantly and had to finish them off, and I remember the look of every one in that instance. I don't lose sleep over it or anything, but they are not fond memories. Seeing that look on a human, and knowing I was responsible, would be tough to live with.

I hear ya. It would be a tough choice.

That said, I look at an intrusion into my home (would be a forced entry as I always keep my residence locked - even when at home) as the 2nd highest personal violation - physical violation being the top one. That, in and of itself "may" offset any of those bad thoughts I'd have to live with.

Dunno.

That strikes me as odd. I find mental violations much more troubling. I'd rather somebody break into my house and beat the crap out of me, rather than have my wife cheat on me. Or be locked up in solitary confinement for a month.

Outside of my family, the foot or so of space between my ears is really my most precious possession.

Good points, all.

I kinda feel sorry for HCP.

I believe in the second amendment, but manslaughter is illegal so make sure you use "reasonable" force.

Absolutely.

Yep, when men in plain clothes invade your home, you gotta shoot first and ask questions later. Like, are you the police?

I live alone so I have no family to protect. So, for me, if I knew that I was not in danger, and there is no threat to loved ones, I simply wouldn't use deadly force. I would not blame others for using deadly force in a similar situation, just not something I would do. I don't have a gun at the moment, but I used to have a 38. But I had that gun as insurance to the world going crazy during a natural disaster or something like that. Also, I am Jewish and think all Jews should be able to defend themselves incase shit acts up again. I gave my gun away to old girlfriend who was being harassed by an ex, I think it's time for me to get a new one.

For most of my life, I've always said I would not shoot someone over stealing my stuff. Always felt I would rather buy more stuff than to live with having killed someone, no matter how much they deserved it.

I live in Lane County, and they 'matirx out' people who are arrested for home invasion (B&E w/owners home), usually in under 24 hours. That puts these sleaze bags back on the street, doing the same thing, the next day. Since that has become so common around here, I've changed my attitude about not shooting people in my house uninvited in the middle of the night. Now it's, break in my house, get your ticket punched.

You have to make some kind of effort not to kill them though. That sounds fair enough.

There is no slick response for this topic.

Or be locked up in solitary confinement for a month.

As an aside: I think (although I may be wrong) that I could do a month of solitary confinement standing on my head. Not literally--I'd be lucky to stay on my head for longer than 30 seconds--but I don't think that it would be that bad. As long as I was fed and I had somewhere to relieve myself... those 7200 hours would be a snap. :)

Philosophically, I think that someone who illegally enters my house should have a reasonable expectation that I will kill them.

Would it be just? I don't know. If they are starving and they enter to take food, at some ethical level they may be justified.

Would it be legal? It depends on where I live, what they were doing when I shot them, etc.

Would I do it? Not now--I don't have a house or a gun. :)

It all depends on the situation. Like if they are holding a knife and come after you.

Or what if they're running off your property and you shoot them in the back? There is a limit to the amount of force you should use.

Philosophically, why? Why is there a limit? If they are running off of your property, they might end up at your mothers, or sisters another night and kill or rape them? Why do they have to be holding a knife? What if they know martial arts and can damage you for ever with a kick or hit to the face or spine?

I have just never understood the line of thinking that they have to have a weapon for them to be considered dangerous.

True story: When I was in high school we had a very good hockey team. One game this punk kept slashing me in my calf, right above my skate. Kept calling me a pussy and such trying to provoke me. Well, I had had enough, and we dropped our gloves and sticks. However, I took my helmet and whipped him across the face. I broke his jaw, eye socket and nose. While a helmet can be used as a weapon, he had one as well. What's to stop a dirty thief from hitting you across the face and causing permanent damage
