Prosecutors recommend 2 years in prison for Raimundo Atesiano

  • Raimundo Atesiano was the chief of police of a small village nested between North Miami and Miami Shores, he had a strategy to create a fictitious 100 percent clearance rate for burglaries. It involved arresting innocent black males to pin crimes on them, prosecutors said.


    Before joining the department of the Village of Biscayne Park, Atesiano had experience in the Miami-Dade County Corrections Department, and as an officer for the Hialeah Police Department.

    FBI agents and Florida Department of Law Enforcement investigators learned Atesiano ordered three of his subordinates at Biscayne Park to violate civil rights in three separate occasions.

    "Atesiano admitted that on one occasion he instructed an officer to falsely arrest and charge an individual for several vehicle burglaries based upon what Atesiano knew were false confessions," prosecutors said in a statement.

    As part of a plea agreement, Atesiano, 52, pleaded guilty in federal court on Friday to conspiring with subordinate officers to violate individuals’ civil rights by making false arrests.

    Atesiano's trial was set to start on Monday. Had he been found guilty, he could have faced a maximum of 11 years in prison. Prosecutors are now recommending a two year sentence.

    Prosecutors identified their victims as "C.D.," "E.B." and "T.C.," a 16-year-old boy. Although the three victims who were targeted were black, prosecutors did not consider race as a factor in the case.

    Former police officers Charlie Dayoub and Raul Fernandez pleaded guilty to deprivation of the victim's civil rights. In return, the state dropped the second charge -- conspiracy to violate civil rights under color of law.

    Three of his accomplices, former Biscayne Park officers Guillermo Ravelo, Charlie Dayoub and Raul Fernandez, had already entered guilty pleas for their roles in the conspiracy.

    Records show Ravelo arrested "C.D." on Jan. 23, 2013 and "E.B." on Feb. 26, 2014. Despite the lack of evidence incriminating them, Ravelo accused "C.D." and "E.B.," two men in their 30s, of burglaries.

    Records show Dayoub and Fernandez arrested the teenage boy on June 13, 2013, and they accused him of being involved in four burglaries.

    The two 2013 arrests allowed Atesiano to brag about the department's clearance rate for burglaries during a council meeting on July 9, 2013. After two years at Biscayne Park, Atesiano resigned as chief in 2014.

    The sentencing hearings are Oct. 4 for Ravelo, Oct. 16 for Fernandez and Nov. 27 for Atesiano
 
I'd be interested to know why the prosecutors didn't consider race to be a factor in the case.

The unmotivated prosecutors took 4 years to obtain those half-assed pleas.

If you or I kidnapped 3 people and imprisoned them for months or years, would we get only 2 years? Those who enforce Law upon the rest of us, don't apply it to themselves. They bully each other, and each local media, into a code of silence.

I've noticed that the "white power" hand sign (never knew this) is the same as the 3 pointer hand sign. Do people think if I throw up 3 goggles at a Blazer game that I'm saying white power instead of simply celebrating a 3 point shot? It's one of those things that seems harmless but I don't want to offend anyone or be associated with racists.

Don’t bring a tiki torch to a blazer game and wave it while celebrating the three.

This. If you notice, they just put up one hand. If you put up two over your eyes you'd be using proper context. I'll say this though, every time I mark a 3 pointer to show I know a guy is behind the line, I throw the white power sign up proudly! LAWL!!

I've seen a bunch of people being outed with pictures of them flashing the sign, which is good that they are being put on blast if that is what they are doing! I just don't want there to be a picture of me celebrating a 3 pointer with the symbol up or mid "Wes 3 Arrow" and be like look at this racists a-hole, ha ha.

A lot of Blazer fans use the three point goggles signal when a three point shot is made. It really started with Wes Matthews.

It was never a white power sign. 4chan made it up to troll people and the media picked it up and ran with it. It’s conpletely ridiculous people even believe it
