Charles Cummings told FOX 13 he heard the victim say he was texting his 3-year-old daughter before Reeves pulled out a pistol.

I assume he was texting a baby sitter or ex-wife?
 
seems reasonable is a stand your ground state. That will be the last time the vic decides to get up in a 71 year olds face.
 
These side effects of our gun culture are not surprising. I think everyone was just lucky he wasn't carrying a hammer or an automobile.

If the texter initiated the physical altercation, and that's a huge if, then an argument can be made for self-defense.

The guy looks like a douche too. The old guy tried to talk to management and the texting guy yelled and started shit. Throwing popcorn is a bitch move.

The physical altercation was something that grew out of a verbal altercation, which was started by Reeves (offender).
Self defense doesnt matter. Reeves brought a gun to a movie theater, and easily could've turned on other people.
 
Physical altercation is pretty ambiguous, but my guess is that the shooter is assumed to have over reacted or he wouldn't be in jail right now.

Reeves asked Chad Oulson several times to stop, to no avail, Nocco said. He then left the theater to complain to the theater's management before returning to his seat, the sheriff said.
Upon his return, “Chad Oulson then starts confronting him verbally, starts saying: ‘Oh, did you go in there and start complaining on me? Did you tell the staff about me?’” Nocco said.


“This verbal altercation starts getting louder and louder. During this altercation, it goes from a verbal to a physical altercation,” he said.
Then, “the suspect, Curtis Reeves, pulled out a gun,” Nocco said.

It would have to be a serious threat for a physical altercation to warrant shooting someone.

He would have to justify that he was unable to leave and feared for his life before he could claim it was self defense.

Take George Zimmerman, for example. His story claimed that the kid was on top of him, beating his head into the cement. Whether you believe the story or not, that would be a situation where you can't escape and you are fearing for your life.

If the guy punched him or something, that's simply not enough to justify shooting him. Not only did he shoot the guy, but he shot the woman as well. It will be interesting to see what other facts come out.

Yeah. Something like that although the media is involved so the prosecutor may be overzealous

The guy is fairly old, 71 I think, so that could contribute to the self defense claim. The other guy was only like 43, so if he started the fight, the older guy could claim that he feared for his life.
 
I could see shooting someone if the movie was nearing the climax, that's at least worth a flesh wound. But during the previews??? That's where I draw the line.

The fact that he shot and hit the wife doesn't bode well for him. I'm having a hard time imagining a scenario where you could be in grave danger without a weapon being involved and hit another person in the process of shooting.

She was trying to pull her husband out of the physical confrontation, and was shot in the hand. Keep in mind he only fired once, the bullet went through her hand and into her husband.

I wonder if there is cell phone video of this out there somewhere?

This is going to be messy.

No weapon involved. Lots of witnesses. This guy is a retired police captain. I don't see any way that he gets off.
