Stephen Breyer is scary

He recently wrote a book and is on tour hawking it. I saw him interviewed yesterday and he's one of those "constitution is a living document" types. The scary part? He said the constitution doesn't define Liberty so basically government and the courts can define it for us.

Wow. Just wow.

I think this kind of thinking is dangerous. It is entirely contrary to what he claims the "living document" philosophy is all about. The constitution isn't about the government granting us Liberty, it's about us granting the government very restricted powers.

It's the Declaration of Independence that mostly defines liberty.

I was going to start a thread on this very item. I was listening to an interview with him, and he sounded so reasonable, so thoughtful that it took a while before his ideas hit me with their full force. It's almost Stalinist. People always talk about Scalia being the "scary" justice, but Breyer is much more dangerous. Scalia at least believes in judicial limits and restraint. Breyer would be comfortable having the government dictate most of our lives.
