Supreme Court to Rule on Gay Marriage

It is pretty easy to see this coming down as a 5-4 split with Anthony Kennedy being the deciding vote one way or the other.

Justice Kennedy may rule in a way many people don't expect, here's why:

Kennedy taught at my law school - he still occasionally teaches summer classes in Europe for the school in fact. The Dean who recruited Kennedy (when he was still a district court judge) many years ago was a highly respected legal authority and law school Dean. He also happened to be gay. He and Justice Kennedy were very good friends until the Dean passed away a few years ago.

I am not saying that Kennedy would rule in favor of gay marriage because of his friend the Dean, but I am saying I am glad that Kennedy had a very close, personal, and human relationship with a man who happened to be gay.

I think that makes a difference, or at least I hope it does.

Kennedy has a libertarian streak, so I think he'll be a yes. I think the government should get out of the marriage business altogether and just offer civil unions. Let religious institutions decide who they will and will not marry. Also, I don't care about the number. People should be left alone to do as they please. As long as they are of the age of consent, let a woman marry five guys or a guy marry five women. It's no one's business but theirs. As for gay marriage, count me among the ones who just don't care.

Clarence Thomas dissented in Lawrence v. Texas, writing that the Texas law was uncommonly silly and that he'd vote to overturn the law if he were a member of the Texas legislature. He found nothing in the constitution to warrant overturning the law, though.

I think affirming gay marriage will be a unanimous descision. It'll be a culture war issue conservatives won't have to deal with anymore. Everyone wins.
