MADISON, Wis. - Wisconsin law bans sex with dead bodies, the state Supreme Court ruled Wednesday in reinstating charges against three men accused of digging up a corpse so one of them could have sex with it.

The court waded into the grisly case after lower court judges ruled nothing in state law banned necrophilia. Those decisions prompted public outrage and a push by a state lawmaker to make sex with a corpse a crime.

In Wednesday's 5-2 decision, the high court said Wisconsin law makes sex acts with dead people illegal because they are unable to give consent.

This ruling shows a clear bias against zombie marriage rights.

I agree with Chutney, zombies everywhere should be outraged.

What happens if they both have a fetish and they write in both write in their will that they agree to it, would that be considered as giving consent?
 
Is zombie sex necrophilia though? Or is it more like getting with a really dirty person, who doesn't bathe or believe in any personal hygiene?
 
Let me see if I got this. These guys dug until they hit the coffin. Then a car pulled into the graveyard. They run away, but get caught running. They never touched the body. One of the kids must have stupidly told the cops their entire plan. That was the wrong thing to do. They could have just only confessed to what they were caught with, instead they told the entire truth. The cops used their words against them, and are going to try to throw the book at them. This just goes to show that it doesn't pay to tell the truth with police. You simply give them more ammunition to use against you in court. Those kids needed to just say nothing at all. If they had just kept thier mouths shut, they would have only been charged with vandalism. Now, it looks like Wisconsin suspended their case just so they could rewrite the law, then use the new law against them. Is that even legal? I find that to be even more twisted than what the kids were trying to do.
