Barkley said she's not a cyclist and didn't seek to demonize the man who hit her by publicizing the case. But, she said, pictures from the scene taken by her husband show markings aren't particularly clear, and a pylon might have obstructed his view before she stepped into the crosswalk.

"There's nothing to tell pedestrians there's a bike lane in front of them, and there's nothing to tell the cyclist there's a pedestrian lane in front of them," she said. "You have to look at the infrastructure and think, maybe this was a cause."

Looking for that big payday. It's not the fault of the cyclist, because obviously cyclists can't be expected to, you know, pay attention to signs and lights etc. It's not the fault of the pedestrian for not looking at the bright green jacket that was flying right at her. It's the fault of the city and the bridge for not being more obvious.

:sigh:

Henceforth known as "The LaMarcus Rule". It's always someone else's fault......

Well, who do you think has more money? The guy on the bike or the city that just built a bridge? They're clearly making a case to sue both. Hell, maybe bicycle guy will get in on the action and sue the city as well!

A separated shoulder and broken ribs aren't sexy enough for a lawyer to take such a problematic case. At least not a smart lawyer.

Utter bullshit. It's CLEARLY marked.

I hate people!

Except you guys of course.

What do you want to bet she was looking at her phone and didn't even see him? Like.... how do you miss the green missile that's flying towards you? I don't get it. Obviously he's at fault because he ran the red light, but I don't see how she just stepped out in front of him.

Looks like another case of a hipster asshole bicyclist who thinks the rules of the road don't apply to them. YOUR LIGHT WAS RED ASSHOLE!!!!!!

This isn't the cities fault at all. Looks to me like they have the proper precautions in place to prevent this from happening. The only thing they could put that would be better is a forcefield which stops idiots in their tracks.

Well, they've been letting these people ride around carte blanche for years, so now they are so entitled that they think the rules don't apply to them.

So damn true. Driving from the burbs to NE every day, see it every day... aggravating.

Is she blind?

Does her head not pivot side to side?

Has she never been told to "look both ways"?

Some people disgust me.

Seems the biker is responsible in the legal sense for running the red light, but she should accept a large part of the "moral" blame because it could not have happened had she used a minimum o common sense.

It looks to me like she does stop, but upon re-watching closely a few times I actually wonder if she intentionally stepped in front of the cyclist. I mean, we've already established motive - Portland drivers hate Portland bicyclists...

Think about it: She looks - see's her light is green, see's bicyclist approaching and thinks "This guy isn't going to even stop is he?" Doesn't think about how bad injuries could be, thinks about potential for a lawsuit, and walks out in front of him. People have done crazier nonsense for the sake of a lawsuit in the past.

That's like saying Salem is filled with convicts, ex convicts and the borderline convict families of both. Hmmmmm......we both may be correct in our assumptions here........
Salem is filled with Methheads, pisas AND mental patients/convicts.

But at least we look both ways and use bike lanes correctly.

I see both sides of the story when it comes to Bikes vs Cars in Portland but here's the gist:

BIKES: FOLLOW THE FUCKING RULES OF CARS AND YOU WILL BE FINE.

CARS: LOOK OUT FOR THE FUCKING BIKES AND FOLLOW THE EXISTING RULES AND YOU WILL BE FINE.

I'm so done with this shit... I ride bikes AND drive. I know WTF should be done...

The issue is that a lot of bike riders like to switch between being a car and riding on the roads, and then to a pedestrian so they can use crosswalks and sidewalks etc. A lot of them don't adhere to stop signs or red lights.

Most issues occur because cars don't see them. I ride a motorcycle often. I wear bright fucking green gear. I wear a full face helmet, leather jacket, leather pants, and leather boots. I am easily visible and protected. I can't even say how many times I've seen bicyclists riding without a helmet, or without lights, or without any kind of reflective or bright material. We are extremely vulnerable when we're out on the roads in anything but a car. I feel like some bicyclists assume that they're seen. They assume that people will give them right of way. When I ride I assume nothing. I expect that everyone is out to kill me and I ride accordingly.

This can be done easily though. There are plenty of bike lanes and crosswalks. If those rules are followed by both Bike and Car lots will fall into place. You are correct though. LOTS of them do not adhere to their traffic safety control devices.

"There was nothing to tell the cyclist to stop, except for a red light." Sue the city.

*sigh*
