Unless Pete King can raise 45 million dollars and Barack Obama turns out to be bad/horrible in his first two years, that seat is going to stay Democratic even if Kennedy isn't in there.

My hunch is that he won't serve.

Even if they can't not seat him, which it appears they can't as decided by the Supreme Court in Powell v. McCormack, they can expel him with 2/3rds vote, which will be easy if the Democratic caucus is united behind Reid in opposition to him.

Blago does have more guts than brains.

And even if they didn't expel him, he'd be a pretty sure lock to lose his next election. Accepting a seat from Blago would be political suicide at this point.

IMO, the only thing Blago can do to try and annoy people is appoint himself to the seat. It would cause a short distraction, until they expelled him.
