This is true the DofI is not a legislative document. It does however give the reason why we have the constitution in the first place. I make this case when we speak of equal rights. If all citizens right to pursue happiness is inalienable, then gay people have the right to be just as unhappy as I was in my previous marriage. ;)

It does no such thing.

It is a list of grievances against the King and reason for "divorce." A declaration of war (independence!).

It is not a reason why we have the constitution. We tried an articles of confederation first.

It does give a glimpse into the philosophy of the founders, though. No mention of health care or retirement programs or income tax, or many of the things you seem to want.

Either Associate Justice Joseph Story wrote what Wikipedia says he did or not. Prove he didn't.

No it doesn't.

Only the 16th amendment allows that. The DofI and constitution never suggested that sort of thing was government power. Quite the opposite. The constitution describes a weak central government that only provides common infrastructure (like central bank, post office, patent office, courts, diplomacy, defense), and no big social programs.
