No, that's one extreme, the other extreme is to say if you have sex with someone who is 17 years 364 days old, it's rape, but the next day, it's consensual sex. You can't say that is rational.

Many people seem to have lost the ability to think rationally on this topic.

It is not uncommon in the hispanic culture for a 16 yr old girl to have a 22 yr old boyfriend (give or take). Both families consent to the relationship, they are in a serious committed relationship and engaged to get married . . . and they engage in sexual activity. The 22 yr old is a normal upstanding person in Mexico, he crosses the border (say legally to avoid derailment here) and he is a rapist in this country.
Is being a pedophile/rapist something that people are born with or is it defined by laws of the country?

The guy in this case would have gone to prison for 20 years, except the state's witness killed herself.
As I read it, he will wait until ond day after puberty. The other "extreme" he mentions is a legal issue, IMO, and not a moral issue. Adults hitting on 13 year-old girls is certifiably disgusting.
49 year-old teachers screwing their 14 year-old students is wrong on every level, IMO, and defending it tells me all I need to know about people.
I think it's silly that people go to prison for having sex with teenagers without proving there was some cohersion in volved. Despite the fact that our society labels them as minors, and despite their psychological short-comings, they are biologically ready to mate. The teenage years are when humans get horny and sexually active, it's just a biological fact. Since it's not inconceivable that they would willingly have sex with someone over 18, those cases shouldn't be considered "rape" by default.
Whether or not something is worthy of being frowned upon, or jail time, are two different things.
"Mr. Rambold, I see you used your position of authority to coerce a troubled youth into having a sexual relationship with you, despite having been warned of such actions by your employer. I also see you've flouted the conditions of the plea bargain and felt the meetings of the mandated treatment weren't important enough to attend. Well, the rape wasn't THAT bad so I'll just give you 30 days."
The judge is saying
The mandated treatment was 3 years, he served over 2.5 of those before getting kicked out for what looks like fairly minor violations. He joined another program and is still serving.

Skipping meetings and taking chances with the conditions of the plea agreement demonstrates a lack of remorse. He got off light to start with and didn't take the treatment seriously. It raises questions about his commitment to rehabilitate.
Tell it to the judge. Oh yeah, that was done.

A legal review of Monday's sentencing suggests Rambold may have gotten off too easily.
That review determined that if Baugh had applied the proper section of state law, the defendant would have received a minimum of two years in prison, according to a memo sent by Yellowstone County Attorney Scott Twito to the appellate division of the state Attorney General's Office.
The state has 20 days to appeal the sentence. Twito said he's working with the appellate division to decide whether to take that step.
