Dare I say it?
Bang Bang Adam Silver's hammer came down on his head...
(apologies to Lennon/McCartney)
Maybe Olshey saw this was going to happen sooner than later. Could be a good reason for him to bolt. I mean the GM has a very personable relationship with owners, so I'm sure the racist comments happened behind closed doors.
Sterling could delay things quite a bit:
1) sure, I'll sell it to my wife (which the league won't allow)
2) sure, who's got $3 billion? (which no one will pay)
According to reported bylaws (woj) if 24 of the other 29 owners vote to make Sterling sell his franchise, then the league would take over running the team temporarily while the team would be put up for auction (which would like be north of 1 billion). There are bylaws I'm sure that have "exit strategies" for events like this. Buying into the league, I'm sure you must sign the bylaws. So I am sure if the owners vote, the price can't come out from "thin air". Most likely "Fair Market Value" will be the wording...
Again, the terms are "ethical" and "reasonable", specifically in relation to how he "conducts business". You're suggesting that those terms can be stretched to include "representation to the public", ie, "public image". That would be an absolutely horrible precedent to set.
Mark Cuban criticizing the officials too much? Giving the league a black eye--strip him of his franchise.
Dan Gilbert issues a statement criticizing Lebron leaving Cleveland? Makes him look petty--strip him of his franchise
Mikhail Prokhorov spends $100M+ on a bunch of aging vets? Makes him look stupid--strip him of his franchise
Joshua Harris allows moves to blatantly tank? Put a bad product on the floor--strip him of his franchise
Maloof Brothers have the Kings miss the playoffs 9 years in a row?--strip them of their franchise
There are myriad ways that an owner can cause his franchise to look bad, without those constituting unethical or unreasonable business practices. Even when they have--such as the Wolves colluding with Joe Smith to circumvent the salary cap--the league never attempted to strip an owner of his franchise. To do it now, in light of prior precedent, would be unsupportable legally.

Suffice to say, I'm shocked. I'm curious to see how the inevitable legal battle plays out.
First, I'm almost certain there is a binding arbitration agreement among the owners.
Second, there is almost certainly a "Fair Market Value" likely using a three appraisal method (one chosen by the owners, one chosen by the arbitrator and one chosen by Sterling). Remember, the owners want a high price as well. SAC and MIL were recently sold, as well as Los Doyers, so there are good figures out there.
And we know it's gonna be expensive. I mean didn't Milwaukee sell for 700 mil or something? The clippers are worth more than that by a long shot.
What I don't want to see is some sort of fire sale. Give Sterling the right amount from the gate, and no suit will warrant the delay. The moment you nickel and dime him, the longer the process can take.
Yep. This is going to court. I'm stunned Silver was this forceful.

I can tell you one thing... I don't expect the Clippers to get "darling" calls anymore. They are about as relevant as any other "small market team" now. I almost think that Silver wants the clips out of the playoffs as soon as possible.
He's a commish of the people!!!

That's just fucking stupid and shortsighted. And probably grounds for a very strong lawsuit on behalf of Sterling.
As I stated, these were private thoughts and conversations, not directives aimed at anyone nor a policy of the ownership to any employees. There is no culture of racism in the organization because it is singularly contained with one man and with him sharing a thought with a person not affiliated with the organization in any capacity.
We live in a society where one's opinions on an issue can now be interpreted as bigoted with them actually being so (i.e. opposing Same Sex marriage). This is the slippery slope. Can a league destroy one's business based on private opinions he held in private?
Yeah the Clippers should be close to a billion probably.
Nice move by Silver. I wouldn't expect that from Stern.
The People's Commissioner should make sure The People's Champ gets some calls!![]()
It's not over yet. Donald will fight it.
