A few things to consider-

Whether or not he should've been arrested for such a petty thing as selling individual cigarettes is a different matter. Personally, I think it is total horsesh!t
Surrounded by a few cops, his hands were visible and clean... and they couldn't use a different tactic to subdue and handcuff him?
Once he threw up his hands and resisted arrest and didn't comply with the cops, they DID have the authority to use "necessary force" to arrest him. (No illegal choke hold with a nightstick)
He said "I can't breath" when they were subduing him on the ground.
What happens if everyone says "I can't breath" when they are being arrested?
He died afterwards and did have a history of Asthma.
