Can somebody who understands exactly what this means break it down? What's it going to take to make it happen, how long? Ramifications?

It means the end of the union. The owners would be subject to anti-trust laws instead of labor/collective bargaining law.

The players would lose all of the things they gained in collective bargaining, like minimum salaries, pension, guaranteed contracts, etc.

The players would be free to negotiate, individually, any contract they want with a team.

I think the players would be naive to do this. Professional sports needs unions.

Am I wrong to believe that that would be a giant clusterfuck!!!!??? What a mess.

This has never happened in professional sports right?

If the union did decertify, Stern predicted the move would backfire.

"If the union is not in existence, then neither are 4 billion dollars worth of guaranteed contracts that are entered into under condition that there's a union, Stern said. "So if the agents insist on playing with fire, my guess is that they would get themselves burned."

Asked if the NBA would employ "scab" players if the NBPA decertificed, Stern said simply: "I don't want to go there now."

Wow! Scab players, could you imagine?

It will be hard, but I will make the sacrifice and cross the picket line.

If there is no union, how can there be "scabs"? I can't believe low and mid-level players would vote to cut their own throats to make the elite players even richer. It's madness.

I remember back in the day scab players playing in the NFL.

CBA expert Larry Coon believes the owners and players essentially have an agreement.

"They've essentially had an agreement for a long time," writes Coon. "It didn't take a crystal ball to see where they would eventually land on the BRI split and system issues. But they still needed to do the dance that gets them there."

But Coon also believes the decision currently facing the players is their biggest one yet.

"Since the stakes rise over time, this is their biggest decision thus far. But it's possible there are bigger decisions yet to come."

While David Stern said on Thursday that the owners are done with negotiations, this will not be their last, best offer.

"If the players say "no" and counter, they can still meet in the middle of next week, Stern's "we're done negotiating" notwithstanding. And if they say "no" and file a decertification petition, this could all come to a head again in January."

Coon believes the players will ultimately accept the current offer and the NBA will play a 72-game season beginning December 15th, but it will be close.

"Derek Fisher has to sell it to the player reps as the best deal they're going to get, with no better option on the horizon. This could still easily blow up, and it's still pretty close to a coin flip. I'd call it a 51/49 split."

Man I'm so relieved after reading this thread. I read the title and thought we were decertifying Denny's board and moving somewhere else. I hate having to move with the holidays coming.

The owners will lose $350M each, if the players leave for Europe and China and are permanently replaced by scabs. With attendance at about 4000 per game, the owners won't take in enough money to pay fixed bills like arena rent, etc. With a bankrupt league, they'll lose their entire investments in the teams.

They haven't officially decertified right?

I think it ultimately means the same thing, one is voluntary and the other is involuntary.

A disclaimer, per Martin, said that the difference between a disclaimer and decertifying is that filing a disclaimer is immediate and doesn't require a vote. Martin expected the lawyers would file an antitrust suit within the "next two days" and possibly this afternoon.

To decertify would take 45 days. This expedites the time process.

does it seem to anyone else like the union strategy has been to avoid a rank-and-file vote at all costs?

I just can't imagine that a majority of players would not have excepted the last offer!

to borrow a phrase...Misters Kessler and Hunter have made themselves into plantation owners, deciding that their folks don't have the savvy to understand how good or bad a deal is, and will just make decisions for them that they don't need to be a part of.

Am I close?

Sure seems that way. It also seems to me, if they thought the players agreed with them, they would tout that as a position of strength. They don't.

Great tweets from Ken Berger

Boies believes he's caught Stern in a gotchya moment when Stern said last Thursday, "The negotiations have ended." I recall that exchange.

Right after Stern said that, Silver jumped in and said, "The negotiations on this proposal have ended." Could be important distinction.

Very astute pick up on Berger's part. At least I think it is
