The drunk driver doesn't purposely want to kill someone. They are just tucking stupid. < and they get punished to the extreme if they murder someone.

The terrorist doesn't plant a bomb and say "I just want to scare a few people and hopefully no one dies". No, they want to kill the innocent and the more deaths the better reward for them.

Well, let's say s/he doesn't, is that really so much better? I mean, with a terrorist or even one at the end of their emotional rope, or even a socially functioning nutbag, at least they might i) come to their senses at some point between the bad idea and the carrying it out, or ii) the plot might be discovered prior to the event due to some carelessness in the planning phase, but with a drunk driver ... that's just an accident waiting to happen ... literally (as some might say).
