It seems similar to a neighborhood homeowners association. If the neighborhood doesn't like you can they force you to sell the house? My guess is that they can only if they violate some provision within the homeowner's contract. I don't think Sterling has and I don't think Cuban believes he has either.

It is the market deciding this. Or rather business owners acting in the interest of maximizing profits in a market. It wasn't the US federal or a state government that decided to come together to form the NBA. It was a collection of businesses and individuals. That collection put together their own constitution with the end goal of securing and maximizing profitability.

The basic question is, "Does keeping Sterling around help the NBA (and thereby the owners) maximize profitability?" This isn't about Big Brother. It's all about the market.

Cuban is asking, "Does getting rid of Sterling create a 'slippery slope' where any owner could lose his ownership if he behaves like a jackass?" You can see why Cuban especially would be worried about this. I don't think this is a slippery slope at all. If I were an owner, I'd keep that in mind and put some limitations in there, but at the end of the day Sterling is damaging the NBA product. His dickishness is sidetracking the playoffs and tarnishing the brand of the entire league. He's an idiot and a dinosaur, and he's done enough damage.

He needs to be careful so his own team doesn't turn on him for not totally the hard line stance. This is proving to be a very sensitive issue

I agree with Mark Cuban. It's what I've been trying to post.

Cuban believes the league constitution will limit that to a fine and suspension...Cuban was concerned about an arbitrary line being set for forcing people out of the league due to controversial beliefs that could be considered offensive. "In this country, people are allowed to be morons," Cuban said. "They're allowed to be stupid. They're allowed to think idiotic thoughts”...Cuban added that it was "damn scary" to ponder the thought of attempting to remove somebody from the NBA because of their private thoughts…"But regardless of your background, regardless of the history they have, if we're taking something somebody said in their home and we're trying to turn it into something that leads to you being forced to divest property in any way, shape or form, that's not the United States of America. I don't want to be part of that."

Cuban knows that he could be next. That's why he voted with Paul Allen against the Sonic move to Oklahoma.

I've decided I want Sterling to keep the team. It's time for the Clips to suck again, and Sterling owning the team would guarantee it.

I don't like Cuban but he's not wrong here.
I don't think Sterling should be forced out unless he effects the BRI of the league and starts costing them $.
I think everything Sterling said was bogus and wrong, and it's no excuse but it was a lover quarrel.
Everyone has a right to their opinion however wrong it is, as well as everyone has a right to voice their opinion unpopular or not.
Which he didn't voice it... it was within his own home with someone he "trusted".
This goes back to the whole tolerance issue, however much that annoys me.
Cannot be intolerant of his views. If your asking for tolerance you must practice what you preach.
This also goes back to what my mother told me when I was 12. Women are EVIL! :P lol :)

But once again what he said is clearly a joke and once he starts costing the league $. He should be removed.




Just out of curiosity, I thought it was illegal to record someone without their knowledge. Shouldn't this chick be facing charges?
it is and I'm sure she will be brought up on charges by sterling and his camp.

What's obvious is that many owners dislike Sterling for assorted unrelated reasons, and are using this incident to vent.

A contract isn't needed to show that this was:

1. A private conversation
2. Recorded illegally
3. Not a directive to anyone associated with the team in any capacity whatsoever

Unless there are corroborating examples or similar directives showing a pattern of this train of though as a Policy of Sterling's, I really don't see what can just punishment can be leveled. Not saying that something won't happen, but in all likelihood it would probably be legally unjustified.

I'm not sure about the "recorded illegally" part. In New York State, recording a conversation is legal if one party consents to the recording. Thus, if I speak to you on the phone and want to record it, I may. Some states require consent of both participants. Not sure what if California is a so-called "one party" state or "two party" state.

I read yesterday that Sterling has been tape recording himself (there are 10 hours of tapes) for posterity. I didn't know whether it was true so I skipped over it. I should have saved the link.

Found it. All I'm remembering is Rush Limbaugh's speculation, which was posted yesterday, I think by PapaG. So, never mind.

What happened here is, best I can tell, he was getting older, he thinks that what he says is profound, and he wants it maintained for posterity. So he asked this V. Stiviano, the latest sugar baby and a little honey, she's telling people that he asked her to record it, because what he says is brilliant. He doesn't have the ability to remember everything he says now 'cause he's 81 years old and he wanted it kept for posterity. He wanted to have a record of what he had said in case there were any disputes with anybody about what he had said.

I think Cuban's right, specifically because of the seizure of property issue. An employer can fire you for whatever reason, but I don't think the league can necessarily force him to sell (unless he's agreed ahead of time to a clause that permits them to).

We are talking about a billion dollar company, the NBA under no circumstances should be even considering forcing him out for things he said recorded legally or otherwise. The man has black players, a black coach one of only a handful of black head coaches in the league. His words might have been racist but in terms of how he has been running the Clippers his actions have not.

If they force him out it would likely require a mass lawsuit settlement on behalf of the NBA or paying him above market value for the team which has been the trend in the NBA lately. That would likely require the sale price to be around 1.5 billion.

The slippery slope is that if one harbors a belief that goes against the majority, one could be stripped of their ability to make a living or survive. Much like the Puritans who came to North America for "religious freedom" would banish someone into the wilderness who didn't adequately practice their religious ideology.

There's been a lot of talk about the Clippers doing another "stronger" anti-Sterling protest for tonight's game, but nobody has any details as to what that will entail. If you were advising the Clippers players, how would you suggest they protest?

No they cannot. But the owners can. There is a clause in the contract where he can be voted out as an owner (According to DP show).

The owners must vote him out. And hopefully they do, Sterling is a disgrace to the NBA and the game of basketball.

Barring that, stitch black patches over "Clippers" on their jerseys.
