Indeed, but there are other types of penalties. So the death penalty isn't needed to give people confidence that laws will be enforced.
Any penalty that isn't enforced leaves less reason to respect the Law .
So we agree; get rid of the death penalty, make it jail time for the most heinous crimes and be sure to enforce it (for confidence/respect/admiration).
When the people see the worst of the worst put to death, they can rest easier that the person will never commit the crime again. And that the Law is protecting them and it works.
Locking them up for life also means they can't kill people. People will know the Law is Protecting them and it Works.
