I don't understand how a summary judgment is going to be quicker than the injunction process. While he clearly knows FAR more about the law than I do, he's also biased (whereas I am not, or at least not very strongly).

A summary judgment may be granted by one or more lower courts, but I would have to think that it would be appealed, and the status quo would be maintained. It might end up costing the owners more in the long run (if they lose) but ... as for saving this season? I don't see how they system can move that fast if either side drags their heels (as they each certainly should, rather than losing so quickly).

and let me introduce you to potentially the most hated players in what was, at one time, the NBA.
 
Plaintiffs in California lawsuit are Melo, Billups, Kevin Durant, Kawhi Leonard and Leon Powe.


Caron Butler, Ben Gordon, Anthony Tolliver and Derrick Williams are plaintiffs in the Minnesota case.

I do understand most of it--at least at a basic level. Of course, I also know that the plaintiffs can claim whatever they want (within some pretty wide parameters) and that courts might not agree... and even if courts DO agree, the remedies might not be what the plaintiffs are seeking.

Rookies are unable to be paid right now and aren't under contract.

The NFL did the same thing. It's the exact same lawsuit, except this time David Boies is pushing it, instead of defending it.

I'm not sure why HCP keeps posting David Boies' talking points, though. Boies is obviously trying to garner some public support for the players in the lawsuit. Problem is, the union never got a chance to vote on a proposal. I wonder which players will 'cross the line' and testify to liking the CBA proposal they were sent by the NBA. That kills this lawsuit right there in my eyes.
 
surprising with Kevin Durant, that changes my perspective a bit, he's a pretty humble dude.

FWIW, Drew Brees and Peyton Manning were both plaintiffs in the NFL's version of this negotiating ploy.

Read Kessler's comments from the NFL case. It's basically the same thing. I also really just meant to point out that Boies is doing what lawyers do, which is try to create a favorable climate for their case and clients.

It's a very clear ethical compass. Defend or support your clients aims to the best of your ability.

He is not fighting one side or the other because he believes in the fight, nor should he. He has been hired to provide legal advise. That simple.
 
I'll remind everyone that the NBA players, would would still have guaranteed contracts and the highest average pay of any professional league in the world, are suing the NBA owners over unfair labor practices.

17% real unemployment nationally, people literally camping out in public and private parks around the country because they have no home, and these players decide that they need to waste everybody's time in order to secure, well, what are they even trying to secure at this point?

I'm just pointing out the irony of the guy who fought this case 4 months ago now advancing it. As I said, there is a reason people have such a low opinion of lawyers. I also believe that people like Boies lack an ethical code in terms of belief, and are basically mercenaries willing to spin whatever truth fits the need of their client. I don't think many people are able to do that, which is why a guy like Boies is always going to have a job.

GOD is great, GOD is good. And he's right.

No two cases are that identical. There are similarities and there are surely significant differences.

The NFL went to the Supreme Court of the USA and lost 9-0 in a case that established them as a cartel. Reggie White had sued the NFL to become a free agent and the settlement became the NFL's previous CBA, administered by a judge.

The NBA may have similar structure and rules, but not identical.

I'm guessing the rookies because the CBA, the draft, rookie scale contracts, RFA, etc., treat rookies special - and deny them the freedom to choose their franchise.

I don't think there is any "right" or "wrong" in how one views another person's ethics. Of course no two cases are similar, but in the NFL's case, Boies and Kessler were adversaries. In this case, they are not. The NFL players sued under the Sherman Act, as well, as a foundation, by the way. Perhaps a bit more time investigating facts, and a little less time playing message board judge, is in order, Your Honor? :)
 
With the announcement of games being canceled in December, the Sportstwo board should rejoice. We will miss some games, but get to find out if proverty truly brings out the "best" in Mrs. HCP.

Seriously though, I do feel bad for you HCP. I am almost tempted to let your wife know that $50 is not the same as 50 pesos. Not going to be the one to spoil the party though.

Toughest part of this so far was last night trying to explain to my 9 year old son and 6 year old daughter how we won't be having our normal XMAS. My son has about 50 things on his wish list!
 
Why won't those stupid players just do what they're told and be grateful to those nice billionaire bosses? After all, they're just a bunch of jumped up jocks with no brains, and it's only by the largesse of visionary wealth-creators that they're not dealing dope on some corner.

What the hell does a bunch of unemployment common folk have to do with NBA players giving the owners billions of dollars? The NBA has been able to increase revenue even while there is a recession; the NBA is projected to have tremendous revenue growth in the next TV contract.

The owners will be ungodly rich regardless of a season being played or not. They won’t have to give up any cars or move to a cheaper mansion or sell one of the two helicopters on their yacht. The players are laying much more of their potential net worth on the line in order to fight the lockout, if NBA players are willing to risk an entire years salary, which for some is an enormous portion of their career earnings, to get a deal they feel is fair, well I can't fault them at all for doing that.
 
I can fault them for their ridiculous, ego-fueled, thug-life-wannabe (yes, I'm looking at you, Melo and KG), dick-measuring definition of "fair deal."

I didn't see the players acknowledge that, in the highest BRI in history, owners lost (according to Billy Hunter) $180M in a supposed "fair deal."
