You're correct, of course, that there's no legal proceeding involved unless Ms. Reade were to file a civil complaint. I doubt that's going to happen, although she did state that she would testify under oath and that's the reason I used that term. I would think that there would be a way that the DNC could conduct an investigation, with an ultimate decision by the DNC as to whether the accusation has sufficient merit as to disqualify Biden as a candidate under the Party's adopted rules. Each presidential candidate is required to "affirm" that they meet the following qualifications:
VI. Presidential Candidates The term “presidential candidate” herein shall mean any person who, as determined by the National Chairperson of the Democratic National Committee, has accrued delegates in the nominating process and plans to seek the nomination, has established substantial support for their nomination as the Democratic candidate for the Office of the President of the United States, is a bona fide Democrat whose record of public service, accomplishment, public writings and/or public statements
affirmatively demonstrates that the candidate is faithful to the interests, welfare and success of the Democratic Party of the United States, and will participate in the Convention in good faith. At the time a presidential candidate announces their candidacy publicly, they must publicly affirm that they are a Democrat. Each candidate pursuing the Democratic nomination shall affirm, in writing, to the National Chairperson of the Democratic National Committee that they: A. are a member of the Democratic Party; B. will accept the Democratic nomination; and C. will run and serve as a member of the Democratic Party.
The bolded part would be the area of consideration.
But I don't think that there's any historical precedent for such a thing happening, so it would have to be very strong evidence of sexual assault.
